 THE MAGNETIC TOYS (SAFETY) REGULATIONS 2008


The above regulation came into force on 21 July this year.  They
require the manufacturers of toys which contain magnets to affix a
warning sign to each toy or its packaging warning that should the magnet
be swallowed it can cause harm to a child> '> s intestines,
particularly
if the child also swallowed either a second magnet of piece of metal.
>
> In the light of this problem it would be worth undertaking a review of
the toys provided for patients to ensure that we do not have any
containing magnets and for staff to be made aware of the regulations.
Whilst we are not selling toys to children we should ensure that any
which we provide for play would meet the regulations.
>
> The law refers specifically to toys that contain or consist of one or
more magnets or one of more magnetic components that are:
>
> * of ingestible shape and size (such as they fit into the small
parts cylinder defined in the European Standard for the safety of toys
EN71 part 1 and:
> * accessible to children in that they are capable of becoming
detached from the toy under normal or reasonably foreseeable conditions
of use by children, even if originally contained, encapsulated, recessed
or collared in the toy.
>
> In future any such toys supplied will contain the following warning:
>
> Warning:  This toy contains magnets or magnetic components.  Magnets
sticking together or becoming attached to a metallic object inside the
human body can cause serious or fatal injury.  Seek immediate medical
help if magnets are swallowed or inhaled.
>
> Toys which fit the category and are already in use must have the
warning sticker affixed prior to sale in the UK.  Again if we provide
toys of this type for play then we may have some liability of sort out
labelling, but we should risk assess the viability of providing such
toys.
>
> It is likely that this would not be a problem for us as I suspect that
we would not make such toys available, however I would be grateful if
you would forward this e-mail to all relevant departments within Child
Health.  Fridge magnets etc would spring to mind.
