An interesting question you raise.  Also, if the eldest son distributes the estate are monies given to the spouse(s) and charities treated as variations to benefit from the IHT exemption?

I believe it may be something to do with in Islamic religions it is down to the eldest son to distribute the estate of the deceased rather than the deceased to write a will which is maybe why it does not come under legacies.  Also in most if not all Islamic religions it is believed that the money you give to worthwhile causes during your lifetime is returned back to you but in greater amounts once you die, so it maybe preferred to distribute your wealth whilst you are still alive.
