TWENTY-SEVEN REASONS TO BURY WIKIPEDIA:

BIBLIOGRAPHIC REFERENCES ON HOMOSEXUAL NAZIS

Recently I was rebuffed in the MSN Group Theism vs. Atheists, and
Wikipedia (both dominated by libertarians and neo-conservatives)
while I was arguing on the same issues, where I asserted that there
was not merely involvement homosexuals within the Nazis but that
support reached the highest levels of the Nazi Party for which I was
harassed, censored, banned and blocked without those groups ever
considering and correcting their errors as they spread their
historical revisionist lies.

In the Wikipedia world of instant book burning where they deleted at
will regardless to content what they may, without proper
consideration. While where Nazis had to actually had to physically
invade peoples homes, to burn real physical books, entailing carrying
those books to where they were to burned, gasoline as a starter,
obtaining matches and strike the match, Wikipedia deleted untold
thousands of writings they are in no position to state had basis or
not, but merely they were processed by an inconsistent process that
wastes the time of valid researchers.

In fact Wikipedia was caught in contradicting itself by their stating
the Nazi Brown Shirt leader Roehm was both a "homosexual"
and "rumored" to be a "homosexual" at the same time which is
impossible for either some one is or not, for it is not a question of
conscience "to be or not to be".

Below are twenty-seven bibliographic references from greatly varied
political sources that specifically support my argument that many of
the Nazi leadership were homosexuals, though it is not politically
correct since many today wish to portray and distinguish homosexuals
as purely victims and not ever victimizers.

Many wish to portray Christians and the religious as "BAD, BAD"
reactionaries never good, and "homosexuals" as "GOOD, GOOD". Many
wish to portray evangelical Christians as representing what is truly
Christians, and that "homosexuals are their victims.

SIMPLY NOT TRUE!

These bibliographic references were draw from Google and such a
diverse group as representing the US government, historians,
communists, social-democrats, Trotskyites, right wingers, and
mainstream writers they do not represent any particular political
ideology except I believe that they are all anti-fascist and Anti-
Nazi.

One week after I has been censored by Wikipedia they have still not
taken action to correct their errors of contradiction and remain to
oppose me on purely bureaucratic grounds with even discussion of the
matter for which I think it is time that the cliques running
Wikipedia get a wake up call as they are the most prominent example
of an online threat steeped much like the Brown shirt Nazis
themselves in deceit, hypocrisy, propaganda, abusive, legalisms, and
historical revisionism.

Wikipedia exists in a strange alliance uniting Libertarians and Neo-
conservatives, and Wikipedia asserted contradictory articles created
in what unites Libertarians, Evangelical Christains, Atheists, Neo-
conservatives, and Hitleran Nazis who defend their Fuehrers to the
bitter end where Wikipedia has more respect for form than substance.

THE FRUSTRATED PRODUCER
 
Dealing today with individuals or corporations society has become very frustrating and without going into  the socialogical morass in which it exists I merely state that the greatest plans of mice and men are subject to failure for most often they can not be made to succeed for either love nor money.
 
I am inclined not to cooperate for with many individuals it is an emotional DRAIN, with corporations it is a financial strain, and with collectives it is a political nightmare so for the present I do my own thing.
 
Recently I released the first version of a video (see below for links )I made and asked a local musician to take a look and maybe write a review to which she responded "why do you want me to do that as you don't like me" in a very personal response she couldn't get past her emotional problem for her response had nothing to do with my request that could of been ignored.
 
I have solicited publicly for people interested in participation and most often have been frustrated where the dividing line is this amateurs do whatever the heck they like unless you bribe them to make them "professionals" in which case most often they are undesiring and unqualified and certainly for the most part don't give a darn about your work for society is a wrok of decadence in progress.
 
I hope you like my vid clips with original sound track, I will be releasing another fuller version soon if you don't respond you must be complacently holding down a day job and have an attitude. Which I must ignor as it is antoithetical to the artistic spirit and spontonity so if needed screw the world.

Wikipedia has articles on the NAZI Brown Shirts, the Brown Shirt leader Rohm, and the Night of the Long Knives (when Hitler at the bequest of his banker financers slaughtered his Brown shirts competitors) those articles for some time contradicted each other in that Wikipedia asserted that Rohm was both rumored to be homosexual and was a homosexual in variance of their fabrication of history with the presentation of different facts.
 
But what can you expect from a bunch founded by a group founded by a smut peddler based on so called Libertarian bureaucrats as: Libertarians are some of the worse abusers of civil liberties are Libertarians as on one hand they demand we live up to they standard of allowing them freedom, but must suffer their imposition of a schizophrenic crazed logic in order to get to where they dictate we should get to.
 
I entered the Theism vs Atheism another so called liberal chat room, and entered into communication in what suffices there for intelligent discourse to be confronted with demagoguery that al that conversation comprises. To my bitter disappointed I was dragged into posting messages in response to a brainless twits that could not find it in their manner to get any real facts into their postings by their insisting that Christians=Anti-Gay=Nazi because they said Nazis were all anti-gay.
 
At some point surrounded by a group of vicious ignorant trolls their words hung on GAYS GOOD, NAZI BAD. GAYS GOOD, CHRISTAINS BAD and I was forced (though I am a minority of one and not a Christian persay) to defend once again those dumb Christians though they have much greater resources than I:
 
Namely because use of what I found as baseless, ill founded, “heathen” stereotypes in lies, presented as truths, abhorrent so as to offend the common standards of decency so as to be offensive to any rational mind.
 
Not all Christians are anti-Gay, nor reactionary, nor do all Christians and Blacks vote for George W. Bush, reactionaries, the Democratic Party, nor are all Gays freedom loving progressives. In fact not all members of groups targeted by some as victims are free of guilt, as if they had nothing to do with those victimizers.
 
Ever since World War Two, Quisling (footnote 1.) has been a word in the public lexicon and vocabulary of intelligence, and Rohm and the Brown shirt leadership were just those types of Quisling traitiors because Rohm and the Brownshirt leadership was GAY (Gay, Gay, Gay, Gay)
BY checking the Wikipedia article on “the Brown shirts”:

BOLDLY THESE TWO PRECEDING WIKIPEDIA references contradict each other BUT WHO CARES FOR TRUTH IN THIS AGE OF INTERNET FABRICATION WHEN WIKIPEDIA CAN DO IT FOR US AND THEN LAUNDER THE FACTS THRU ITS LEGALISTIC SYSTEM OF BUREAUCRATS WHILE THEY REMAIN ABOVE IT ALL BY CLAIMING TO BE FREE LOVING SPIRITS.
 
But who cares if we mince the truth?

While reading the article, I had stumbled upon this in the History section: :"Röhm was unpopular in the party because others saw his ambition as threatening their own, and because he was a homosexual." As my reward I was censored, blocked, and Wikipedia redacted my corrections and reverted them to maintain the lies and myths Wikipedia perpetuates in what appears to be presented as a cover for Nazi Activity on Wikipedia so as to preserve the Nazi image.
 
“Konrad Heiden, a contemporary of Hitler and a leading authority on Nazi history, wrote that the Freikorps "were breeding places of perversion" and that "Rossbach's troop...was especially proud" of being homosexual (Heiden: 295). Rossbach's adjutant was Edmund Heines, noted for his ability to procure boys for sexual orgies. Ernst Roehm, recruited by Rossbach into homosexuality, later commanded the Storm Troopers for the Nazis, where they were more commonly known as the SA (an acronym for Sturmabteilung).”
 
In my own defense I refer to “Homosexuality and the Nazi Party by Scott Lively” (Scott Lively is co-author of The Pink Swastika: Homosexuals and the Nazi Party (Keizer, Oregon: Founders Publishing Company, 1995). I STRONGLY URGE THAT WIKIPEDIA BE FINANCIALLY NOT BE CONTRIBUTED TO AND THAT COCERTED EFFORTS BE MADE (if possible) it undermine its tainted existence that is perpetuated on lie deceit and historical revisionism.

Quisling, became a label was conceived in remembrance after Norwegian fascist politician Vidkun Quisling, as a term used to describe traitors and collaborationists. It was most commonly used for fascist political parties and military and paramilitary forces in occupied Allied countries which collaborated with Axis occupiers in World War II Europe, as well as for their members and other collaborators.
 
That Quisling's name should be applied to denote the whole phenomenon of collaborationism is probably due to the place of Norway on the list of countries occupied by the Third Reich. There were few Polish collaborators, other than the Volksdeutsche, and Denmark fell within a few hours. Thus, Norway was the first country where local, non-German, fascist parties took a part in the conquest of the country. In contemporary usage, "Quisling" is synonymous with "traitor", and particularly applied to politicians who appear to favor the interests of other nations or cultures over their own.

The Rise and Fall of the Third Reich, author William Shirer describes Roehm as "a stocky, bull-necked, piggish-eyed, scar- faced professional soldier...[and] like so many of the early Nazis, a homosexual" (Shirer:64). Rector writes:
 
Was not the most outstanding, most notorious, of all homosexuals the celebrated Nazi leader Ernst Ro[e]hm, the virile and manly chief of the SA, the du buddy of Adolf Hitler from the beginning of his political career? Hitler's rise had in fact depended upon Ro[e]hm and everyone knew it. Ro[e]hm's gay fun and games were certainly no secret; his amorous forays to gay bars and gay Turkish baths were riotous. Whatever anti-homosexual sentiments may have been expressed by straight Nazis were more than offset by the reality of highly visible, spectacular, gay-loving Ro[e]hm. If there were occasional ominous rumblings and grumblings about "all those queers" in the SA and Movement, and some anti-gay flare-ups, homosexual Nazis felt more-or-less secure in the lap of the Party. After all, the National Socialist Party member who wielded the greatest power aside from Hitler was Ro[e]hm (Rector:50f).
 
Betraying his roots in the "Butch" faction of the German "gay rights" movement, Roehm viewed homosexuality as the basis for a new society. Louis Snyder writes that Roehm "projected a social order in which homosexuality would be regarded as a human behavior pattern of high repute...he flaunted his homosexuality in public and insisted that his cronies do the same. What was needed, Roehm believed, was a proud and arrogant lot who could brawl, carouse, smash windows, kill and slaughter for the hell of it. Straights, in his eyes, were not as adept in such behavior as practicing homosexuals" (Snyder:55). "The principle function of this army-like organization," writes historian Thomas Fuchs, "was beating up anyone who opposed the Nazis, and Hitler believed this was a job best undertaken by homosexuals" (Fuchs:48f).
 
The favorite meeting place of the SA was a "gay" bar in Munich called the Bratwurstglockl where Roehm kept a reserved table (Hohne:82). This was the same tavern where some of the earliest formative meetings of the Nazi Party had been held (Rector:69). At the Bratwurstglockl, Roehm and associates-Edmund Heines, Karl Ernst, Ernst's partner Captain Rohrbein, Captain Petersdorf, Count Ernst Helldorf and the rest-would meet to plan and strategize. These were the men who orchestrated the Nazi campaign of intimidation and terror. All of them were homosexual (Heiden:3
 
Indeed, homosexuality was all that qualified many of these men for their positions in the SA. Heinrich Himmler would later complain of this: "Does it not constitute a danger to the Nazi movement if it can be said that Nazi leaders are chosen for sexual reasons?" (Gallo:57). Himmler was not so much opposed to homosexuality itself as to the fact that non- qualified people were given high rank based on their homosexual relations with Roehm and others. For example, SA Obergruppenfuhrer (Lieutenant General) Karl Ernst, a militant homosexual, had been a hotel doorman and a waiter before joining the SA. "Karl Ernst is not yet 35," writes Gallo, "he commands 250,000 men...he is simply a sadist, a common thug, transformed into a responsible official" (ibid.:50f).
 
This strange brand of nepotism was a hallmark of the SA. By 1933 the SA had grown far larger than the German army, yet the Vikingkorps (Officers' Corps) remained almost exclusively homosexual. "Roehm, as the head of 2,500,000 Storm Troops," writes historian H.R. Knickerbocker, "had surrounded himself with a staff of perverts. His chiefs, men of rank of Gruppenfuhrer or Obergruppenfuhrer, commanding units of several hundred thousand Storm Troopers, were almost without exception homosexuals. Indeed, unless a Storm Troop officer were homosexual he had no chance of advancement" (Knickerbocker:55).
 
In the SA, the Community of the Special's Hellenic ideal of masculine homosexual supremacy and militarism was fully realized. "Theirs was a very masculine brand of homosexuality," writes homosexualist historian Alfred Rowse, "they lived in a male world, without women, a world of camps and marching, rallies and sports. They had their own relaxations, and the Munich SA became notorious on account of them" (Rowse:214). The similarity of the SA to Freidlander and Brand's dream of Hellenic revival is not coincidental. In Gay American History, Jonathan Katz writes that Roehm was a prominent member of the Society for Human Rights (SHR), an offshoot of the CS (J.Katz:632).
 
The "relaxations" to which Rowse refers were, of course, the homosexual activities (many of them pederastic) for which the SA and the CS were both famous. Hohne writes that Roehm "used the SA for ends other than the purely political...Peter Granninger, who had been one of Roehm's partners...and was now given cover in the SA Intelligence Section. For a monthly salary of 200 marks he kept Roehm supplied with new friends, his main hunting ground being Geisela High School Munich; from this school he recruited no fewer than eleven boys, whom he first tried out and then took to Roehm" (Hohne:82).
 
Hitler's "Gay" Roots
In 1945 a Jewish historian by the name of Samuel Igra published Germany's National Vice, which called homosexuality the "poisoned stream" that ran through the heart of Nazism. (In the 1920s and 30s, homosexuality was known as "the German vice" across Europe because of the debaucheries of the Weimar period.) Igra, who escaped Germany in 1939, claims that Hitler "had been a male prostitute in Vienna at the time of his sojourn there, from 1907 to 1912, and that he practiced the same calling in Munich from 1912 to 1914" (Igra:67). Desmond Seward, in Napoleon and Hitler, says Hitler is listed as a homosexual in Viennese police records (Seward:299). Lending credence to this is the fact, noted by Walter Langer, that during several of those years Hitler "chose to live in a Vienna flophouse known to be inhabited by many homosexuals" (Langer:192). Rector writes that, as a young man, Hitler was often called "der Schoen Adolf" (the handsome Adolf) and that later his looks "were also to some extent helpful in gaining big-money support from Ernst Ro[e]hm's circle of wealthy gay friends" (Rector:52).
Langer, a psychiatrist, was commissioned by the Allies in 1943 to prepare a thorough psychological study of Hitler. His report, kept under wraps for 29 years, was published in book form in 1972 as The Mind of Adolf Hitler. Langer writes that Hitler was certainly a coprophile (a person who is sexually aroused by human excrement) and may have practiced homosexuality as an adult. He cites the testimony of Hermann Rauschning, a former Hitler confidante who "reports that he has met two boys who claimed that they were Hitler's homosexual partners, but their testimony can hardly be taken at face value. More condemning," adds Langer, "would be the remarks dropped by [Albert] Foerster, the Danzig gauleiter, in conversation with Rauschning. Even here, however, the remarks deal only with Hitler's impotence as far as heterosexual relationships go, without actually implying that he indulges in homosexuality. It is probably true that Hitler calls Foerster 'Bubi,' which is a common nickname employed by homosexuals in addressing their partners. This alone is not adequate proof that he has actually indulged in homosexual practices with Foerster, who is known to be a homosexual" (Langer:178). However, writes Langer, "Even today, Hitler derives sexual pleasure from looking at men's bodies and associating with homosexuals" (Langer:179). Too, Hitler's greatest hero was Frederick the Great, a well-known homosexual (Garde:44).
Like Langer, Waite also hesitates to label Hitler a homosexual but cites substantial circumstantial evidence that he was.
 
It is true that Hitler was closely associated with Ernst Ro[e]hm and Rudolf Hess, two homosexuals who were among the very few people with whom he used the familiar du. But one cannot conclude that he therefore shared his friend's sexual tastes. Still, during the months he was with Hess in Landsberg, their relationship must have become very close. When Hitler left the prison he fretted about his friend who languished there, and spoke of him tenderly, using Austrian diminutives: 'Ach mein Rudy, mein Hesserl, isn't it appalling to think that he's still there.' One of Hitler's valets, Schneider, made no explicit statement about the relationship, but he did find it strange that whenever Hitler got a present he liked or drew an architectural sketch that particularly pleased him, he would run to Hess- who was known in homosexual circles as "Fraulein Anna"-as a little boy would run to his mother to show his prize to her...Finally there is the nonconclusive but interesting fact that one of Hitler's prized possessions was a handwritten love letter which King Ludwig II had written to a manservant" (Waite, 1977:283f).
 
Hitler, if homosexual, was certainly not exclusively so. There are at least four women, including his own niece, with whom Hitler had sexual relationships, although these relationships were not normal. Both Waite and Langer suggest that his sexual encounters with women included expressions of his coprophilic perversion as well as other extremely degrading forms of masochism. It is interesting to note that all four women attempted suicide after becoming sexually involved with Hitler. Two succeeded (Langer:175f).
 
The Homoerotic Brotherhood
Whether or not Hitler was personally involved in homosexual relationships, the evidence is clear that he knowingly and intentionally surrounded himself with practicing homosexuals from his youth. Like Roehm, Hitler seemed to prefer homosexual companions and co-workers. In addition to Roehm and Hess, two of his closest friends, Hitler filled key positions with known or suspected homosexuals. Rector, himself a "gay Holocaust" revisionist, attempts to dismiss sources that attribute homosexuality to leading Nazis, but nevertheless writes that...
 
Reportedly, Hitler Youth leader, Baldur von Schirach was bisexual; Hitler's private attorney, Reich Legal Director, Minister of Justice, butcher Governor- General of Poland, and public gay-hater Hans Frank was said to be a homosexual; Hitler's adjutant Wilhelm Bruckner was said to be bisexual;...Walter Funk, Reich Minister of Economics [and Hitler's personal financial advisor] has frequently been called a "notorious" homosexual ...or as a jealous predecessor in Funk's post, Hjalmar Schacht, contemptuously claimed, Funk was a "harmless homosexual and alcoholic;" ...[Hitler's second in command] Hermann Goering liked to dress up in drag and wear campy make-up; and so on and so forth (Rector:57).
 
Igra, who confidently asserts that the above men were homosexuals, cites still other Hitler aides and close friends who were known homosexuals as well. He states that Hitler's chauffeur and one-time personal secretary, Emile Maurice, for example, was homosexual, as well as the pornographer Julius Streicher, who "was originally a school teacher, but was dismissed by the Nuremberg School Authorities, following numerous charges of pederasty brought against him" (Igra:72f). SS Chief Heinrich Himmler's "pederastic proclivities [were] captured on film" by Nazi filmmaker Walter Frenz (Washington City Paper, April 4, 1995). Reinhard Heydrich, mastermind of the first pogrom, Kristallnacht, and of the death camps, was homosexual (Calic:64). In The Twelve Year Reich, Richard Grunberger tells of a party given by Nazi propagandist, Joseph Goebbels, which degenerated into a homosexual orgy (Grunberger:70). A recent biography of Albert Speer by Gitta Sereny speaks of a "homo-erotic (not sexual) relationship" between Speer and Hitler (Newsweek, Oct. 30, 1995). Langer notes that Hitler's personal bodyguards were "almost always 100 percent homosexuals" (Langer:179). Hitler's later public pronouncements against homosexuality never quite fit with the lifelong intimacy-sexual or otherwise-which he maintained with men he knew and accepted as homosexuals.
 
In light of the above it is not surprising that many of those whose ideas influenced Hitler were also homo-sexual. Chief among those were occultists Jorg Lanz Von Liebenfels and Guido von List. In 1958, Austrian psychologist Wilhelm Daim published Der Mann der Hitler die Ideen gab ("The Man Who Gave Hitler His Ideas") in which he called Lanz the true "father" of National Socialism. Lanz was a former Cistercian monk who had been excommunicated for homosexuality (Sklar:19). After being expelled from the monastery, Lanz formed an occultic order called the Ordo Novi Templi or The Order of the New Temple (ONT). The ONT was an offshoot of the Ordo Templi Orientis which practiced tantric sex rituals (Howard:91).
 
On Christmas day, 1907, many years before it would become the symbol of the Third Reich, Lanz and other members of the ONT raised the swastika flag over the castle which Lanz had purchased to house the order (Goodrick-Clarke:109). Lanz chose the swastika, he said, because it was the ancient pagan symbol of Wotan, the god of storms (Cavendish:1983). (Wotan, the inspiration for "Storm Troopers," was the Teutonic equivalent of Baal in the Old Testament and Zeus in Greek culture). Waite notes that it was through Lanz that Hitler would learn that most of his heroes of history were also "practicing homosexuals" (Waite, 1977:94f). 71).

Workers Memorial Day is held each year on April 28 to mourn workers killed and injured on the job. In honor of these workers, this day also marks our rededication to the fight for improved workplace safety.
Working conditions have improved over the years due to the efforts of workers and their unions. But the fight to protect all workers must continue as the toll of workplace injuries, occupational diseases, and deaths remains enormous.
Consider these facts:
  • An estimated 152 workers are killed and 11,507 are injured on the job each day.
  • In 2005, the most recent year of available data, 4.2 million workers were injured and 5,734 workers were killed because of on-the-job hazards.
  • Another 50,000-60,000 workers died due to occupational diseases.
  • Also in 2005, the number of fatalities among immigrant workers increased by an alarming 63 percent since 1992, amounting to 1,035 deaths.
Why are still so many workers and their families suffering unnecessarily?

Unfortunately, the Bush administration continues to turn its back on workers and workplace safety. Siding with its corporate friends, the administration has overturned or blocked dozens of important workplace protections, including the Occupational Safety and Health Administration’s (OSHA) ergonomics standards, and new protections on Tuberculosis, reactive chemicals, and cancer-causing substances.
This administration impairs protections, favoring “voluntary compliance” over enforcement among the seven million worksites that OSHA overlooks, which is estimated at less than one percent. OSHA has issued only one significant health standard since Bush’s presidency, and that was because of a federal court order.

A perfect example of OSHA’s failure to protect workers is the agency’s eight-year delay in requiring employers to pay for personal protective equipment (PPE). First introduced in 1997, the PPE rule would make employers pay the costs of protective clothing, lifelines, face shields, gloves and other equipment used to protect workers from job hazards.
In 1999, OSHA promised to issue the final PPE rule, but missed that deadline and every self-imposed deadline since. The agency failed to act in response to an AFL-CIO and UFCW petition in 2003. This year, the AFL-CIO and UFCW sued OSHA, asserting that the Bush Administration’s failure to act on issuing the final PPE standard is putting workers in danger. By OSHA’s own estimates, 400,000 workers have been injured and 50 have died due to the absence of this rule. Workers in some of America’s most dangerous industries, such as meatpacking, poultry and construction, and low-wage and immigrant workers who suffer high injury rates, are vulnerable to being forced by their employers to pay for their own safety gear because of OSHA’s failure to finish the PPE rule.
Another pressing issue OSHA is failing to move on is regulating the exposure to diacetyl, a deadly chemical used in flavorings. In July 2006, the UFCW and Teamsters petitioned the Department of Labor (DOL) for an Emergency Temporary Standard for diacetyl under Occupational Safety and Health Act.
 
 
Diacetyl is a hazardous chemical that has been connected to a potentially fatal lung disease that has been experienced by food industry workers across the nation. There have been dozens of cases of what has become known as "popcorn workers lung," or bronchiolitis obliterans—a severe, disabling, and often-fatal lung disease experienced by factory workers who produce or handle diacetyl.
 
In 2002 and 2003, OSHA’s own scientists studying diacetyl unsuccessfully urged their leaders to take broader action to protect workers. There are currently no OSHA standards requiring exposures to be controlled.
 
The petition in July was accompanied by a letter from 42 of the nation’s leading occupational safety scientists, including a former OSHA director, five former top officials from OSHA, the Environmental Protection Agency, and the Department of Health and Human Services, who all agree that there is more than enough evidence for OSHA to regulate.
 
In an April 25 New York Times article, Stephen Labaton writes about OSHA’s lack of concern in enforcing workplace safety and exposing dangerous on-the-job conditions during the Bush administration. In talking about OSHA’s lack of urgent response to the danger of diacetyl, Labaton says,
“…That response reflects OSHA’s practices under the Bush administration, which vowed to limit new rules and roll back what it considered cumbersome regulations that imposed unnecessary costs on businesses and consumers. Across Washington, political appointees—often former officials of the industries they now oversee—have eased regulations or we4akened enforcement of rules on issues like driving hours for truckers, loggin in forests and coporate mergers.”
Meanwhile, good jobs—jobs that pay living wages and provide affordable health care and pensions—are disappearing. While corporations’ profits continue to grow, they are cutting employees' pay and outsourcing needed jobs. Worker safety and health protections—rarely a priority for most employers—will be further threatened in a low-wage economy.

The time is now for us to make workplaces safer and to make sure the clock is not turned back, that our progress is not in vain, and that workers are not made disposable.
On April 28, let us mourn the workers who have lost their lives on the job and rededicate our fight against such injustices and every worker’s right to a safe job. We must recognize that millions of workers in the U.S. continue to work in pain and lose their livelihoods because of work-related injuries and occupational diseases. We must force the Bush administration and Congress to urgently take action to protect all workers.

Occasionally I get some inspiration but usually every day life can be very mundane in every day existence no matter how much we resist it, cause guess what no matter who, or what we are we eat, piss, sleep, and die.
 
Born into this life, millionaires, serial killers, retards, and regular working stiffs start off all the same, though from the get go they are afforded the same advantages.
 
Though superfluously we can qualify those many diverse lives (and life styles) by saying that people are “not afforded” exactly the same advantages, we are all start of approximately the same, and rationalize that debate by use of many additional arguments:
Fairly within a sane world the facts speak for themselves they are not, and so: one must ask if in a democratic society can afford those radically divergent lives.
 
I can easily make an argument from within a corporate perspective that where the corporation is paramount in that the CEO can be over paid (as they are) none the less they are dependent on the abilities of those in their employ but that is a disingenuous argument.
By making such disingenuous unfair arguments I am no better than the corporate world built upon the contrived paper trails of family stocks, bonds, and law, constitutional, statutory, administrative, and traditional implementations of policy that we can trace as if they were biblical genealogies.
 
In playing chess seriously there are merely two perspectives of playing chess, besides those of personal enjoyment of the game, the aesthetics, there are only issues of tactics and strategy.
Strategy in chess in the long term goal of winning (what ever that means), and tactics are the means by which we achieve those goals.
 
On a day to day basis we are constantly bombarded by propaganda in the form of advertising that focuses on the tactics of living, not the final goal of the deeper meaning of what we call life.
 
Common place today the propaganda says drink, eat, sleep, lie, cheat, pray, believe, and be a phony, but in actually it is most shallow no matter how much it is dressed up to appear cute, tough, smart, intelligent, and hip, to the point where there is no correlation between what we see, hear, and say, and our real lives.
 
What suffices for “reality TV”, interviews of “real people”, the “real world”, a “real woman”, a “real man”, a “real education”, a “real job”, “ a “real family”, “ a “real pair of tits”, “real poetry”, “real musicians”, “real hip” (generally what we see in every day) is all a sham except if it pertains to us, our families, our friends, our neighbors, our world, our planet.
 
I can not say that I am a fan, but instead think by the year 2007 that I am relevantly an extreme cynic of practical theoretical basis, founded in general application upon the facts:
 
Civilization has been mostly founded upon lies and deviance from what it normally self-sanctimoniously presents itself and there for exists as a social aberration. The cultural psychotic can present them selves on an equal footing the respectable family man, the billionaire, the executive, the cop, the priest, though in reality their arguments are only acceptable within what are presumably different social circles.
 
Woman can present themselves as equal to man; poor illiterate can present themselves as equal to the educated middle classes, children can argue they are equals to adults, and conversely based on the arrogance of power the same can be said in return.
 
What a crock of shit (though “shit” is not a word that adequately conveys the problem in view) as it pertains to the tactical use of rhetoric it is merely an emotional expression of those who lose patience and tire of such arguments heard every day, day after day. Semantically legal arguments that fill the media, law books, books, newspapers, the internet, TV, art reviews, government, corporations, conversation, life, and living, as same people subsist on the cliches of such arguments in which they have merely passively participated as spectators.
Perhaps the entire world should demonstrate in this life it has the ability to shut the propaganda off so as to send a message, as well as to prove to themselves that they can shut off such devices and separate themselves. Cough. Cough. I admit often I often inundate with media as it pertains to me as I work, or to my work itself, in the solitary confines of what amounts to a cell that perhaps I have all too much become accustomed to, as it is so much simpler than dealing with the world as a whole.
 
There is no sense of reality as young and old are affected in a fog of delusions that extends from cradle to grave but which suffices for some as life that greatness has problems and is the demise of many that can be only pitied though I am constantly asked:
“What makes me feel I am so right and everyone else so wrong?
 
But that is twisted where critical facts are answered not by response on the matters of the facts but by questioning the integrity of theose who dare to ask the questions, calling a spade, a spade, by saying 1=1 and 1+1=2.
 
I do not have the pretensions of any fancy job and salary, and perhaps naively I have never aspired to such heights, though often I have of desired to be empowered to do what I do on some grander scale greater than doing my own thing, at home alone. Such grandeur is unimportant though many aspire to such heights I imagine I have actively walked away from such opportunities as I found the desires egotistic evils, and the temptations strange and foreign manipulations.
 
Diagnosis of such issues can occur in many manners on both a personal and political social scale though ultimately such manifestations are not questions of “nature or nurture” but “nature and nurture” (not a question of “the chicken or the egg” but the chicken and the egg. Such gregarious erroneous clichés permeate or social use of language, they are common, and in that case vulgar and obscene of little or no value, as at best they serve to convey in shorthand greater ideas that should be dwelled upon and properly discussed not given short shrift.
 
Human language is often conveyed by use of commonality, where there are certain accepted aspects of convention that can be weighed in technical, societal, and social importance by being placed on a scale of one to ten, where both stereotypes, and individuality have played no small part.
 
On one hand most people get depressed, most people have anxieties, most people have fears, in what communal is diagnosed every day by health professionals, and because of that fact that: most people get depressed, most people have anxieties, most people have fears, many
state that psychology is baseless.
 
On the other hand in that we are bombarded by information, in blatant or passive forms of propaganda

So the question is how should these be addressed as for many that question is not adequately addressed but glossed over and ignored, as that is why we have social ills and emotional problems alike.
 
Though often parents and society state they are concerned where the individual can not
perceive the problem, harping on how much inconvenience and trouble they go to “help”, on an individual personal and social level, the individual is more concerned than others because they are the ones affected, though individuals are is not empowered to cure such distinctions.
 
Individuals can not function for many reasons; many are in personal denial of such dysfunctionality in their lives, while others are in denial of how much they act in callous indifference to others’ problems. Merely because it is so difficult to handle and cope with others, and because in giving we deprive ourselves of what we may need, and which in extreme cases may cause our own deaths we don’t. If people give for others without regard to themselves they are called saints and heroes, but to call everyone a saint or a hero is to demean use of those words.
 
In actuality astute psychologists and mental health workers recognize this and refer to the statistical basis of weither behavior is considered (or not) a social norm, but that only occurs where a society has a norm that reasonably they maintain weither or not there is reason to do so.
 
In the deeper meanings of life there are no easy answers and most could not be found dwelling on such thoughts, but in every day life those deeper meanings affect everyone, everything. What actually exists is a failure to communicate, in what exists as an inability to communicate, and we tend to act on and not communicate, in dysfunctional use of language, in a society demeaned every day by corrupted use and practice of language.
 
So why there any wonder that the world is so screwed up?
 
Why are we constantly told (or not) what to do, how to do it, and why?
The answer is simple because that is the fabric that hold society, fortunes and wealth, families, corporations together, simply the bullshit that no one wants to hear in that fact that they are liars, society often is a lie.
 
Have I said people stop the world to get off, or they should or should not, could or could not be responsible? Now way, for that is the way of the intellect, the logic it produces, and the society it manifests, the reasons to act at times, the bottom-line being is that ultimately it is the lack of leadership. In what is said to be leadership, in a failure of leadership, of leaders of whom a price should be exacted but instead rewarded as they are the ones pulling the strings in a double standard they talk the world out of, and deprive it of real meaning and justice contrived in what makes little sense.

Every one has seen the “Republican” Political action committee ads posing supposed veterans when those are not all veterans. With all the lip service paid by reactionary establishment leadership to freedom and democracy as they wave the American flag time and time again like trained monkeys, it is time to draw a line in the sand to expose their lies and deceit. In regard to veterans first conned into the service by recruiting officers, then sent to war to be used as cannon fodder and then neglected in health care when they return they do not really give a damn, nor do they care about freedom and democracy for they follow a long established policy of deceit from which they derive their linage:
 
Between 1936-39 preceding World War II, while the conservative leadership of the so called free bourgeois democratic world (including President Roosevelt Prime Minister Chamberlain) appeased Hitler, Mussolini, Franco, and the reactionary Roman Catholic Church hierarchy there was a group of Americans that gave up they youth, and lives to fight fascism called the Abraham Lincoln Brigade *1 they did not sit comfortably at home.
 
The Abraham Lincoln Brigade volunteers were part of the International Brigades a greater effort comprising tens of thousands of anti-fascist volunteer combatants that went to Spain to defend the democratically elected government of Spain against Franco fascists in league with the German Nazis and fascist Italian troops in support of American interests. While the Nazi Germany and Fascist Italy bombed Spanish cities in support of Spanish fascism, the great liberals foundations of the Industrial world sat by and did nothing or collaborated with the fascists.
 
Members of the Abraham Lincoln Brigade came from many walks of life and different political progressive political backgrounds left without the approval and consent of their government returned to be label premature anti-fascists and communist when they weren’t.
Whereas the Flying Tigers received the approval and recognition of the US government and Roosevelt five years after the start of the Spanish conflict, the veterans of the Abraham Lincoln Brigade never received such recognition, nor were they accorded pensions, benefits, or allowed into the US military when World War II started.
Whereas European members of the resistance were accorded honors by their respective governments all Abraham Lincoln Brigade veterans should be given, or posthumously receive all honors and benefits as American (US) veterans of World War II would of received.
*1 Abraham Lincoln Brigade - In the Spanish Civil War, a brigade consisted of four to six battalions. [1] American volunteers mostly joined the two battalions (the Lincoln Battalion and the Washington Battalion) within XV International Brigade. The XV International Brigade was made up of six battalions of volunteers from nations around the globe, topped up with Spanish conscripts. [2]
 
As time went on, the name Abraham Lincoln Brigade became used loosely, in the United States, as shorthand to describe any unit with an American component. Volunteers from the United States also served with the Canadian Mackenzie-Papineau Battalion; the Regiment de Tren (transport); and the John Brown Anti-Aircraft Battery. North Americans also ran a very well-organized and well-equipped field hospital (funded and staffed by the American Medical Bureau to Save Spanish Democracy).

HILLARY GET IT RIGHT? By Andrew Stergiou

Sorry folks my primary language is English, and for some time I have carried the Democrats.us banner on my web site http://zito.biz , but after reading “the Hillary Clinton for President Exploratory Committee” first online ad I felt very uneasy. Because since `1956 the Republicans have not won elections Democrats have lost elections, as the democrats often have failed to grasp the significance of matters when they should have, but did not.
 
The immediate case in point exemplifying most USA politicians shallow presentations they start off on the wrong foot under estimating the common person’s perceptions, means, and inclinations, where then it is a small things that grows bigger and bigger that destroys them.
 
Perhaps you agree, perhaps you do not agree but let’s start by examining the issues of the brief sparse information I found for it was a simple matter of logic. Firstly let it be known that in some sense I’d love to be able to believe at least one person in America can be trusted though bitterly I fear I will always be disappointed.
 
The ad for “the Hillary Clinton for President Exploratory Committee” read:
 
Let the Conversation Begin”, “Join Hillary Clinton for a live conversation about the future of our country. Please submit the following information to register for this event. All items marked with an * are required.”
 
“The Hillary Clinton for President Exploratory Committee” states in the next sentence that:
 
“Due to the anticipated volume of inquiries we will not be able to answer each question individually or guarantee a personal response. Questions may be condensed and answered together in order to respond to as many submissions as possible.”
 
Clearly the first sentence represents a promise to that there will be a dialogue with the American people, who as a people will be represented by those attending the above entitled function, but then it will not be a free and open discussion but one of a controlled and limited natured, of docile prepared and scripted questions, and answers, not that I would subject even Senator Clinton to the rabid logic of the American right. None the less “the Hillary Clinton for President Exploratory Committee conversation contrived, and controlled, is not a real conversation by which I for one feel cheated, and regret as she maybe should stand face to face with some of these reactionary bastards, and suffer as we do.
 
I would have had preferred she face panel of mature ordinary citizens who after a life of maturity, education, and living have learned the biter disappointments of living in the USA so as to be angry, but also gained the wisdom of a tolerant, and well balanced wisdom by which they can temper that anger, and frustration, but allow them to speak and ask freely in a manner politicians are never spoken to. I do not real know who they would pick I am sure they will have views on the matter but in the end fearing the circumstances would refrain from doing so. So as I fear these things I pray Hillary gets it right though I fear there most often are not miracles of the type we need as the systemic political corruption of the USA is so wide spread in actually I don’t discuss election issues but demand investigations for I do not feel it can function without understand how the political system in the US has been undermined by the military-industrial complex, and the fascist police state that the Democratic Party has been bipartisan part and parcel in that they created it and can not separate themselves.

Pass a Clean Miniumum Wage Bill
Yes, they did it again. The Senate defeated a clean minimum wage increase that is nearly 10 years overdue.
A majority of senators—54—voted to raise the minimum wage from $5.15 an hour to $7.25 without handing out more business tax breaks. But the mostly Republican opponents of a clean minimum wage increase filibustered the measure, and it takes 60 votes to end debate on a filibustered bill. Now the Senate will take up a minimum wage bill that includes tax breaks and other giveaways President Bush wants—and it’s expected to pass.
So, once again, millions of minimum wage workers have to wait for a raise while the House (which passed a clean minimum wage increase) and Senate work out the differences between their versions of the legislation.
Low-wage workers have been at the back of the line long enough.
Tuesday night, in his State of the Union Address, President Bush claimed the economy “is on the move” and growing. Not for minimum wage workers, that’s for sure. The real buying power of their paychecks is at the lowest point in more than 50 years. Today, a full-time minimum wage worker makes just $206 a week, $10,712 a year—far below the poverty line for even a small family.
Businesses have gotten $300 billion in tax breaks since the last time minimum wage workers got a raise. It’s time to demand a clean minimum wage increase.

TURMOIL AND CORRUPTION IN MEXICO by Andrew Stergiou
 
Recently the I read as to how the Mexican Federal government has started cracking down by use of its military in a blog posting entitled “The Tyrant Will Fall” which I can whole heartedly sympathize with (as I hate all tyrants). Accompanied by photographs of the Mexican military Inspect[ing] vehicles for drugs, weapons, and people” that is not sufficient to suit all purposes.
 
The posting continued saying “It seems that the Mexican Government is going to do what many Mexicans have been asking for since 1910” though one would ask why it continued if the people never wanted it. Surely someone wanted the corruption. Surely someone profited from the corruption, the drugs, the trafficking, etc, so continuing on to say that
 
“the Mexican Government is going to do what many Mexicans have been asking for since 1910” – get rid of the corrupt, greedy and criminal element that has only added to the woes of the oppressed.”
 
“The new president, Calderon is being praised for his hardnosed crack down on the drug syndicates that virtually control all the politics along the US/[Mexican] border.“
 
But those familiar with the Humphrey Bogart movie Casablanca could not for get the scenes where the chief of the police raided the casino he patronized, regardless of the bribes he took, and crimes he committed, which is not to suggest the current or past presidents of Mexico committed any crimes as it is not necessarily a field I am expert in.
The blog continued saying that:
“Today, there are 3000 troops in Tijuana enforcing the law. The local TJ Police have been disarmed and placed on suspension pending a stringent investigation that will leave many of the current police unemployed and possibly charged with crimes ranging from accepting bribes to murder. All police weapons were confiscated and are being tested for ballistic matches with crime scene evidence. Mexican] Military monitoring traffic and inspecting vehicles
 
In what appears at best to many as martial law, dictatorially imposed from above, so then we can ask who are the tyrants those imposing themselves as federal authorities exporting law and order dictatorially from Mexico City to the border regions, in it finds it self between a rock and a hard place to satisfy US public opinion, or those who actually represent success of what has existed there for decades.
Though many state:
 
“I must take my hat off to Calderon for this unprecedented action, it is a positive step towards solving one of the major problems facing Mexico and can serve as an example to other Latin American countries. It is also a sure fire way to prevent a revolution, which has been on the verge of occurring in the past few months because of what has happened in Oaxaca.”
 
I must state that the federal government would have no credibility in their intervention locally if they did not put on the show, appearing to crack down on the local criminal elements, and corruption, besides harassing the local people. If the federales did not crack down on the local criminal elements, those elements are independent enough to represent a political challenge so if it is real I predict a split in the PAN.
 
Also otherwise, the federal government would not appear to be acting fairly (not that local police care about appearances of fairness), but in that:
What is said to be carried out to prevent a “revolution”, decried as “a revolution” but like in 1910 (as many radical movements), was merely necessary as changes to bring Mexico peacefully into the 21st century, not a banana republic of have and have-nots, but as a modern democratic state that all parties in Mexico denounces depending on who does what, but which in reality actually exists.
Before I commented on that blog posting I had to check some of my facts (namely as to the results of the recent Mexican presidential elections, and I did) so sorry, if it offends anyone BUT:
 
The new president Felipe de Jesús Calderón Hinojosa has become the President of Mexico Incumbent, ahead of the National Action Party (Partido Acción Nacional, known by the acronym PAN, a conservative and Christian Democratic party and one of the three main political parties in Mexico) Serving a term of office that began on December 1, 2006 and expires on November 30, 2012.
 
The area in which PAN, the president, and Mexico’s last president, and the border criminal gangs draw political strength from the same exact Northern Mexican border region. Strangely the photos of a military crackdown show the military crack in the Tiajuana area, when in actuality the largest of the major criminal drug gangs in based in Juarez , so PAN, and the president appears to be cracking down on his own, so something is not what it appears.
 
All those elements has the same political constituencies, and elements, which is said to be in the process of change, (in a perfect world) but though those elements are not the same exact elements, they are all dependent, and beholden, and in debt to each other:

So there is no basis for changes which were claimed or suggested, as it all appears to be some kind of whitewash smokescreen cover-up to satisfy the political needs of the federal office so as to satisfy the US, and the north American public clamoring for change themselves.
 
Mexico is again in turmoil and the simple people of workers and peasants are paying in blood, for what robs Mexico and its people of its future. PAN today often represents many of the same elements which represented reactionary elements opposing the Mexican Revolution of 1910. That revolution began due to the inflexibility of Mexican politics and static conditions that remain the same for most Mexicans hence the cause why they and other people in Central America risk coming to the USA as illegally. PAN also as noted represents many of those border areas which are traditional corrupted by the lucrative trafficking trade there. It also contains many maquiladoras form a lucrative business for the multinational corporations raping both the USA and Mexico.
 
he Mexican revolution began with a call to arms made on 20 November 1910 by Francisco I. Madero, in what lasted until 1921. It is estimated that the war killed 900,000 of the 1910 population of 15 million. The president then did not live to see the fruit of that revolution as he was murdered in 1913, but what existed then, in the like of Generals Poncho Villa, and Emilio Zapata still exists today, in the soul of rebels that constitute the Zapatista movement.
 
Today the Mexican opposition represents the majority of Mexicans not PAN, namely the:
 
Institutional Revolutionary Party (Partido Revolucionario Institucional, PRI) – under different names, at the local, state, and national levels for most of the 20th century. Although a part of the Socialist International, it is most often perceived as left of center, supporting a policy of mixed economy and nationalized industries, both of which are longstanding Mexican practices.
 
Party of the Democratic Revolution (Partido de la Revolución Democrática, PRD) – a left of center party. Born as "National Democratic Front", a splinter group of the PRI, in the 1988 elections. Its first candidate and founder, Cuauhtémoc Cárdenas, lost the 1988 presidential election under dubious circumstances, which eventually helped the party consolidate itself. It is currently in power in the Federal District and in several other states.
 
Labour Party (Partido del Trabajo, PT) – a far-left political party formed in 1990. It is often allied with the PRD for electoral purposes.
 
Green Ecological Party of Mexico (Partido Verde Ecologista de México, PVEM) – a minor party with an environmental platform. During most of its existence the party has been controversially managed by a single family.
 
Convergence (Convergencia, formerly Convergencia por la Democracia) – a minor party, formed in 1997.
 
Social Democratic and Farmer Alternative (Alternativa Socialdemócrata y Campesina, also known simply as Alternativa) – a party formed by former members of the Social Democracy Party and the Cardenist Front of National Reconstruction. It was established in July 14, 2005.
 
New Alliance (Nueva Alianza) – originally created by academics of the Autonomous Technical Institute of Mexico and members of the National Teachers Union. It was established in July 14, 2005.
 
Diversity is slowly coming to Mexico, though many may claim that Mexico (the only Latin American member of the Organization for Economic Co-operation and Development [OECD] since 1994), Mexico is firmly established as an upper middle-income country.”:
 
Such elements falsely circulate misinformation stating 30-35% of of the population belongs to a middle class element, those economic groups are neither homogenous nor static, but dynamic with many different factions represented today in Mexican politics. That in other countries (e.g. Argentina, Brazil, Bolivia, Nicaragua, Chile etc), today again have come to assert some independence in changing their governments administrations. Which well occur time and time again until the lessons of history are really learned, though so many North Americans often do not and attempt to change things in retro mode of what existed but which does not exist in that what they say:
 
“As the only Latin American member of the Organisation for Economic Co-operation and Development (OECD) since 1994, Mexico is firmly established as an upper middle-income country.”
 
But all too often we have seen thing like that change over night (e.g. Cuba, Argentina) the thin margins of distinction are just that very thin lines.
“Populist”, “radical”, “reformist” change currently sweeping south America which I predict eventually will engulf in Mexico, radically affect Mexican politics, as the National interests of that country are best represented by those elements not compromised by international political interests, nor concerns of vested interests represented by the reactionary hierarchies of the church/Christianity.
 
Currently appearing in the media as the revelation of President Chavez of Venezula, while the reactionaries thinks pretentiously revolution is confined to Cuba, dictated in Cuba, and ruled over by Fidel Castro, in that they forget the radical Simone Bolivar and the historical movements of America de Sud, which hopefully will be resolved by the people of Mexico, not the gangs, generals, corporations, church, bureaucrats, or politicians.

Spam, Professionalism, Burnout, and Material Rewards by Andrew Stergiou.
 
Recently I accidentally approved a bunch of spam emails in what has become part of a very tiresome, boring, and at times rewardless process. Where the monopoly process has an effect on the public in their immature and corrupt state not only expects to be catered to, often demands it, where ever fringe element becomes mainstream with corporate sponsorship of one for or another. Where the rewards of independent artists, writers, intellectuals has become marginalized except with corporate support, and sponsorship, where the artistic nature of youth, is sold out in middle age, to be rewarded by employment.
 
Spam is can only be seen as the flip side of corporate venues of internet access, where success is rewarded by the flocks of albatross that follow the ship and the offal strewn overboard as it makes its rounds before port.
 
Spam that has been regularly posted by technical means to some of my email groups (where people are supposed to participate and post messages after registration that has created a burdensome task.
 
But where is the public, while the military and conservative corporate types hire professionals to stalk lurking thru the internet in service of those political financial interests? Often they too are drawn up into the process and think, honestly thru their perspectives that their views which are subjected to a constant bombardment of propaganda, and rhetoric truly espouse some independent views when in actuality it is most difficult and I admit I too have been so duped by sophisticated tricks and maneuvers by reactionary pigs.
 
It is an old story with many projects I have attempted to get off the ground from when I first attempted in High School to start and underground “rag” and I serious addressed the issues of “concentration camps” which were prepared by Nixon, and was reported by Scanlon magazine and the Rand Corporation, my “radical friends” in high school were more inclined towards Mescaline and “tulips” (uppers). An old story, where I am offered little encouragement, and still yet fewer rewards in a world predicated on the rulers and the ruled.  In a world based on not merely money, but a society based on power, founded on the accumulation of wealth, that pits me self against the slick and professional corporate world, that shakes in continuing Industrial revolution, and which maintains itself dictatorially, thru authoritative, totalitarian, and democratic means where they are so allowed.
 
Most often these email groups serve the egos of their “masters” (moderators) or if completely open some other design beyond control of either the moderators or the users. Where often those groups have no relation to the true meaning of those email groups many are shill based (as is evidenced by the lack of participation, or legitimate use).
 
In a society where the rewards are not based on virtue, profundity, ethics or morality, but where ideals, principle, the profound, nationalism, prejudices, truth, justice, law, ethics, god, power, wealth, evil and good exists solely to serve that society based on raw power, and the crude accumulation of wealth.
 
I admit that in the class prejudices of stereotypes I was accustomed, taught, and raised, that to date are not exactly true but questionable as the decadence of the rich, and old money, the nouveau riche, and the working class, the poor, and the lumpen classes was not the same but distinguished:
 
In a manner I find often difficult to explain, but not to refute, as those I oppose are even more baseless than I, an with less foundation, and facts, rather than views which often I admit I have not nor desire , as I prefer to speak as I do rather than as some may wish. For I speak in serious matters truly most often not as opinion but as fact.

SCREW THE GRAMMYS: AN OPEN LETTER TO CARMINE D’AMICO by Andrew Stergiou
(Why are you being a jerk?)
Recently I received a message from Carmine D'Amico a distinguished notable musician acquaintance of mine of some accomplishment, that I had  a link to from my Yahoo 360 blog page (http://360.yahoo.com/andrew_zito), where he and I have linked blogs, by what yahoo refers to as "friends", though we have never met.

Actually now he has pissed me off, and I don’t mind letting him know, since he started it by “shooting his mouth off” then deleted me from his list of complacent friends when I rebutted him, as he closed off his comments section to postings by me. So I will post this response on my blog as I found him to be intellectually gutless which I don’t mind saying:
As a musician I have great respect for my hard working fellow musicians (as all musicians should), but add what musicians earn a living from isn’t always from being a musician. Often the distinction as to weither or not they earn a living is based on how well connected. There are musicians who earn money as studio musicians, producers, side men, orchestra musicians, or even in bar bands, which requires, and all too often entails not mere musical ability by political clot. An often rowdy musician up on stage acting out that bad boy image, isn’t exactly what you find off stage as then they are tame and well behaved, as they are too busy trying to get away with indulging themselves, habits etc..
Generally their earning power is based on political clot that can diminish when one makes comments that are found to other disliking, like what happened to the Dixie Chicks some years back  when they gave George W. Bush a few well earned blasts, or if they are sellouts they can parley themselves like Ronald Reagan,and so many super starts did.
Being that Carmine has much success, that according to his site releases includes winning 24 Grammy  awards.
Carmine D’Amico has played (performed) guitar for/with the likes of Frank Sinatra, the Rolling Stones, and Bill Crosby, his credentials might go on forever. Carmine p
layed “guitar on 2 Marianne Faithful CDs, produced by Stones' guitarist Keith Richards.” (Carmine’s Blog), one can not deny his has been on the inside of the music world. Maybe he was there and got the inside story when Marianne Faithful allegedly “got the boys hooked on heroin” who knows.
In any case Carmine signed to Major Label at the age of 9 (Carmine site), which means he started working for that perhaps when he was 5 or 6, which means he has me beat by about 14-15 years considering I started playing when I was 19. Perhaps  In a way he reminds me of my granddad who started working making and fixing shoes when he was 6 years old, as part of the work ethics of southern European Mediterranean peoples have, working to eat, even when they don’t have to. Working if we need money, working just for the heck of it, it does not matter we need to do something just to keep busy and to prevent insanity, in the curse of Saint Agnes, for which we bury ourselves in WORK even if there is no money involved.
I seem to remember this guy Carmine from down in the Little Italy Section of SOHO Manhattan back in the days on Spring Street before it became trendy, and there were Italians, in little Italy and you din’t have to import them from Italy.  I seem to remember from his photo being in the window of Rudy’s Music Shop on 48th street in Manhattan. But what does all that mean? I have a brain? I am not losing it to senility? Who knows but I like, love, my memories, even when I don’t like them because they are mine, and I am attached to what I am familiar with as mine.
I seem to recall some one else who was involved producing Grammy hits (like Cramine), and in that instance as he was only a 2-3 time Grammy winner he earned surprisingly a low $350 an hour as his standard rate for mercenary services to produce a major label record (according to him), as one would figure it might have been more, as there are many issues of royalties labeled producing fees, and the like that add up.
In any case a musician for the moment it was an honor to be communicating with Carmine and so as to say in his presence, BUT (and that is a big buttttt), but like all celebrity types with inflated egos I learned a long time ago in dealing people (who like getting their way like anyone else) it is a question of honesty, cause if they want to get their way that is one thing but if it goes against honesty and truth the are superficial and worthless which is how I peg Carmine.
So without pulling punches, and being as fair as possible, without being too nice I was very disappointed in receiving a message from Mister Carmine D’Amico as that message was very strange, regarding the war in Iraq and jingoistic rhetoric, though critically I have observed from a distance the sides involved as technically as of yet still I have not supported nor opposed the war in Iraq (you can see that right? Good!)
He wrote in short:

Carmine I don't know if you realize it but the military has attempted to use civilians (i.e. you and me) to influence things to their (policy wonkers) advantage by have paid propagandists hype issues, when in this case they as the "US MILITARY" can buy ship etc whatever they want.

In fact I was employed for a company that was a military supplier of their PXs, my family was in the military, and I have a $1000 that says there is no real basis to that concocted story you accidentally posted which in its demeaning manner trivialized the issues. in actuality for the duration of this undeclared war (another undeclared war, how many more undeclared wars) I have not either been for or against it hoping that it exposes the crazy politics of this country as the sides argue, I have succeeded but now add that the administration has been the most underhanded and dishonest, as Saddam Hussein was a friend of the US establishment then for merely money he wasn't. Tell me one thing: What makes those establishment creeps any better than common criminals, nor beholding to a different standard, where RICO for me, is not RICO for them, and as they commit criminal acts every day in lying?

THE CURRENT STATE OF THE PROBLEM WITH AMERICA
 
Circuit Judge Roberts, who reviewed issues in these matters, and later sat on the United States Circuit Court of Appeal for the District of Columbia, later yet sits today on the United States Supreme Court is very revealing, regardless of the details of the quaint rationale, and logic which was used as an excuse to justify his mindset which is so typical of tyrants, and dictators.
 
The American courts which expects a certain measure of comity, in regards to American law, they base on it grand sense of "logic", that (1) directly affects the jurisprudence of all countries on major issues of the day, which that judge and American Jurisprudence most often has decided with the most senseless, brainless, naive, stupid, pretentious, improper of means:
 
That the world most often can clearly see as the travesty it is when America's system of justice, and leaders are judged by what they decide on the most basic levels, where most often there is no money available to represent the poor, the under-privileged, and the lower economic classes of a society at war with a world, that begins by claiming it is always better, gentler, kinder, most just, most fair, and of course best country in the world:
 
When from those decisions insight is derived into how the American "leadership (sic) Democrat, and Republican, will decide the larger greater issues of war, peace, progress, heaven, hell, language, truth, and justice.
 
Typical people before the courts in the US are censured, and censored, by claims that they:
 
  1. infringe on the dignity of the court
  2. act in contempt of court
 
Typical courts are supposed to have the appearances of propriety that allows decisions of those courts to stand as   dignified impartial bodies, which can be depended upon as being fair, just, and good, based on some measure of truth and fairness.
 
What Justice Roberts starts with what I describe as insincere "crocodile tears” in his saying:

events that led to this litigation. A twelve-year-old girl was
arrested, searched, and handcuffed. Her shoelaces were
removed, and she was transported in the windowless rear
compartment of a police vehicle to a juvenile processing
center, where she was booked, fingerprinted, and detained
until released to her mother some three hours later — all for
eating a single french fry in a Metrorail station. The child
was frightened, embarrassed, and crying throughout the or-
deal. The district court described the policies that led to her
arrest as ‘‘foolish,’’ and indeed the policies were changed after
those responsible endured the sort of publicity reserved for
adults who make young girls cry. The question before us,
however, is not whether these policies were a bad idea, but
whether they violated the Fourth and Fifth Amendments to
the Constitution. Like the district court, we conclude that
they did not, and accordingly we affirm.
I.
It was the start of another school year and the Washington
Metropolitan Area Transit Authority (WMATA) was once
again getting complaints about bad behavior by students
using the Tenleytown/American University Metrorail station.
In response WMATA embarked on a week-long undercover
operation to enforce a ‘‘zero-tolerance’’ policy with respect to

violations of certain ordinances, including one that makes it
unlawful for any person to eat or drink in a Metrorail station.

§ 35-251(b) (2001). ‘‘Zero tolerance’’ had more
fateful consequences for children than for adults. Adults who
violate § 35-251(b) typically receive a citation subjecting them
to a fine of $10 to $50. Id. § 35-253. District of Columbia
law, however, does not provide for the issuance of citations
for non-traffic offenses to those under eighteen years of age.
Instead, a minor who has committed what an officer has
reasonable grounds to believe is a ‘‘delinquent act’’ ‘‘may be
taken into custody.’’ Id. § 16-2309(a)(2). Committing an
offense under District of Columbia law, such as eating in a
Metrorail station, constitutes a ‘‘delinquent act.’’ Id. § 16-
2301(7). The upshot of all this is that zero-tolerance enforce-
ment of § 35-251(b) entailed the arrest of every offending
minor but not every offending adult.
The undercover operation was in effect on October 23,
2000, when twelve-year-old Ansche Hedgepeth and a class-
mate entered the Tenleytown/AU station on their way home
from school. Ansche had stopped at a fast-food restaurant on
the way and ordered a bag of french fries — to go. While
waiting for her companion to purchase a fare-card, Ansche
removed and ate a french fry from the take-out bag she was
holding. After proceeding through the fare-gate, Ansche was
stopped by a plainclothed Metro Transit Police officer, who
identified himself and informed her that he was arresting her
for eating in the Metrorail station. The officer then hand-
cuffed Ansche behind her back while another officer searched
her and her backpack. Pursuant to established procedure,
her shoelaces were removed. Upset and crying, Ansche was
transported to the District of Columbia’s Juvenile Processing
Center some distance away, where she was fingerprinted and
processed before being released into the custody of her
mother three hours later.
The no-citation policy was not, it turned out, carved in
stone. The negative publicity surrounding Ansche’s arrest
prompted WMATA to adopt a new policy effective January
31, 2001, allowing WMATA officers to issue citations to
juveniles violating § 35-251(b). See Deposition of Capt. Mi-

chael Taborn at 28, 55. Zero tolerance was also not a policy
for the ages. Effective May 8, 2001, WMATA adopted a new
Written Warning Notice Program, under which juveniles
eating in the Metro are neither arrested nor issued citations,
but instead given written warnings, with a letter notifying
their parents and school. Only after the third infraction over
the course of a year may a juvenile be formally prosecuted.

On April 9, 2001, Ansche’s mother Tracey Hedgepeth
brought this action as Ansche’s next friend in the United
States District Court for the District of Columbia. The
complaint was filed under 42 U.S.C. § 1983 and named
WMATA, its General Manager, the arresting officer, and the
District of Columbia as defendants. It alleged that Ansche’s
arrest violated the equal protection component of the Fifth
Amendment, because adults eating in the Metro were not
arrested. The complaint also alleged that the arrest was an
unreasonable seizure under the Fourth Amendment. The
complaint sought declaratory and injunctive relief against the
enforcement policies leading to Ansche’s arrest, and expunge-
ment of Ansche’s arrest record.

On cross-motions for summary judgment, the district court
ruled in favor of the defendants. Hedgepeth v. Washington
Metro Area Transit, 284 F. Supp. 2d 145, 149 (D.D.C. 2003).
Addressing the equal protection claim, the court applied ‘‘the
highly deferential rational basis test,’’ id. at 156, because it
found that age is not a suspect class, id. at 152–53, and that
there is no fundamental right to be free from physical re-
straint when there is probable cause for arrest. Id. at 155.
The court then ruled that both the District’s no-citation policy
for minors and WMATA’s zero-tolerance policy survived ra-
tional basis review. Id. at 156–58. The district court next
rejected Ansche’s Fourth Amendment claim, relying on Atwa-
ter v. City of Lago Vista, 532 U.S. 318 (2001), for the

proposition that ‘‘ ‘[i]f an officer has probable cause to believe
that an individual has committed even a very minor criminal
offense in his presence, he may, without violating the Fourth
Amendment, arrest the offender.’ ’’ 284 F. Supp. 2d at 160
(quoting Atwater, 532 U.S. at 354). Given that it was undis-
puted that Ansche had committed the offense in the presence
of the arresting officer, the district court concluded it was
‘‘without discretion or authority to reject the standards enun-
ciated’’ in Atwater, despite the minor nature of the offense
and the harshness of the response. 284 F. Supp. 2d at 160.
Hedgepeth now appeals.
II.
We are confronted at the outset with two jurisdictional
objections. First, Ansche’s complaint seeks only prospective
relief,

and — even in the absence of WMATA’s change in
policy — we are not willing to indulge the assumption that
she will violate D.C. C
ODE
§ 35-251(b) in the future and
thereby again be subject to the policies about which she
complains. This suggests the lack of an ongoing case or
controversy under Article III. See City of Los Angeles v.
Lyons, 461 U.S. 95 (1983) (plaintiff subject to illegal arrest
procedure lacked standing to seek prospective relief because

relief would not establish standing or defeat mootness objections.

he made no showing that he was likely to be arrested and
subjected to illegal procedure again); O’Shea v. Littleton, 414
U.S. 488, 495–96 (1974) (‘‘Past exposure to illegal conduct
does not in itself show a present case or controversy regard-
ing injunctive relief’’).
Second, WMATA argues that its new policy for juvenile
offenders renders the case moot. There is no need for the
court to assess the legality of the policy to which Ansche was
subjected, WMATA argues, because that policy — a combina-
tion of a no-citation rule for minors and zero-tolerance en-
forcement — is no longer in effect.
The answer to both objections is found in the precise relief
sought by Ansche. In the complaint, Ansche sought not only
declaratory and injunctive relief with respect to the no-
citation and zero-tolerance policies, but also the expungement
of her arrest record. Second Am. Compl. ¶ 32(c). She
clarified in her summary judgment papers that this last
request included a judicial declaration deeming her allegedly
unlawful arrest a ‘‘detention.’’ See Memorandum in Support
of Motion for Summary Judgment (Feb. 21, 2003) at 23.
Such an order would relieve Ansche of the burden of having
to respond affirmatively to the familiar question, ‘‘Ever been
arrested?’’ on application, employment, and security forms.
This court has approved such relief in the past. See Carter v.
District of Columbia, 795 F.2d 116, 136 (D.C. Cir. 1986);
Tatum v. Morton, 562 F.2d 1279, 1285 n.17 (D.C. Cir. 1977).
Ansche accordingly has Article III standing, and her effort to
secure such relief has in no way been affected by WMATA’s
policy change.

WMATA also argues that, as a state-level governmental entity
with sovereign immunity, it is not a ‘‘person’’ subject to liability
under 42 U.S.C. § 1983, citing Will v. Michigan Dept. of State
Police, 491 U.S. 58, 71 (1989). Ansche, however, has also named as
a defendant WMATA’s General Manager in his official capacity, and
‘‘[o]f course a state official in his or her official capacity, when sued
for injunctive relief, would be a person under § 1983 because
‘official-capacity actions for prospective relief are not treated as
actions against the State.’ ’’ Id. at 71 n.10 (quoting Kentucky v.
Graham, 473 U.S. 159, 167 n.14 (1985)).

This action is justiciable with respect to both the District of
Columbia and WMATA. Although each tries to blame the
other, Ansche alleges that neither defendant’s policies alone
would suffice to cause the alleged violation: but for
WMATA’s zero-tolerance policy, there likely would have been
no enforcement of § 35-251(b) against Ansche; but for the
fact that District of Columbia law did not authorize citations
to minors, the zero-tolerance enforcement of § 35-251(b)
would not have required Ansche’s arrest.

narily when two tortfeasors jointly contribute to harm to a
plaintiff, both are potentially liable to the injured party for

By the same token, it appears that both WMATA and the
District would be implicated in the relief that confers stand-
ing and defeats mootness. Ansche was arrested by a
WMATA officer and detained and processed in a District
facility. Records concerning the episode have been generat-
ed by both WMATA and the District. See Transit Police
Event Report at J.A. 304–07; Metropolitan Police Dept.
Delinquency Report at J.A. 308–09. If redress in the form of
an order of expungement and a declaration that Ansche’s
arrest was a detention were appropriate, such an order would
properly run against both WMATA and the District.
III.
Ansche first contends that her arrest violated the equal
protection component of the Fifth Amendment. See Bolling
v. Sharpe, 347 U.S. 497, 498–99 (1954). Adults eating in the
Metrorail station during the undercover operation could be,
and almost uniformly were, given citations; similarly situated

minors could only be and were subjected to the far more
intrusive invasion of arrest. During zero-tolerance week,
twenty-four adults violating § 35-251(b) at WMATA facilities
were issued citations, whereas fourteen juveniles were arrest-
ed. WMATA’s Answers to Interrogatories at 7.
The first step in analyzing Ansche’s claim that this dispa-
rate treatment violated equal protection is to determine the
proper level of scrutiny. Strict scrutiny demands that classi-
fications be narrowly targeted to serve compelling state inter-
ests and is reserved for suspect classifications or classifica-
tions that burden fundamental rights. Intermediate scrutiny
requires that classifications be substantially related to impor-
tant governmental interests; it is applied to so-called ‘‘quasi-
suspect’’ classifications. Under rational basis review, a classi-
fication need only be rationally related to a legitimate govern-
mental interest. See Kimel v. Florida Bd. of Regents, 528
U.S. 62, 83–84 (2000).
Ansche argues for heightened scrutiny — strict scrutiny or,
more plausibly, intermediate scrutiny — for two distinct
reasons: first, classifications based on status as a minor are
‘‘quasi-suspect’’; and second, her arrest burdened her funda-
mental right to be free of physical restraint by the govern-
ment. The district court correctly held that neither theory
supported heightened scrutiny.
A.
Ansche acknowledges that the Supreme Court ‘‘has said
repeatedly that age is not a suspect classification,’’ Gregory v.
Ashcroft, 501 U.S. 452, 470 (1991) (citing cases), and instead
has analyzed equal protection challenges to age-based classifi-
cations under rational basis review. She argues that those
cases are distinguishable, however, because they concerned
classifications discriminating against the elderly, as opposed
to the young. Youth, according to Ansche, bears many of the
hallmarks of a suspect classification: a history of discrimina-
tion, immutable characteristics, and political disenfranchise-
ment. See Lyng v. Castillo, 477 U.S. 635, 638 (1986). Thus,
she concludes, there should be heightened scrutiny of distinc-

tions burdening the young, even if there generally is not of
distinctions based on age.
This court has noted in passing that youth is not a suspect
classification. See United States v. Cohen, 733 F.2d 128, 135
(D.C. Cir. 1984) (en banc); see also Hutchins v. District of
Columbia, 188 F.3d 531, 536 n.1 (D.C. Cir. 1999) (en banc)
(plurality opinion). Other circuits have reviewed classifica-
tions based on youth under a rational basis standard. See
Stiles v. Blunt, 912 F.2d 260, 266 (8th Cir. 1990); Douglas v.
Stallings, 870 F.2d 1242, 1247 (7th Cir. 1989); Williams v.
City of Lewiston, 642 F.2d 26 (1st Cir. 1981). We agree with
the conclusions of these circuits.
Although Ansche is correct that the Supreme Court cases
applying rational basis review to classifications based on age
all involved classifications burdening the elderly, see Ramos v.
Town of Vernon, 353 F.3d 171, 181 n.4 (2d Cir. 2003), she has
presented us with no persuasive reasons to conclude that
classifications burdening children should be treated different-
ly. Heightened scrutiny is reserved for classifications based
on factors that ‘‘are so seldom relevant to the achievement of
any legitimate state interest that laws grounded in such
considerations are deemed to reflect prejudice and antipa-
thy.’’ City of Cleburne v. Cleburne Living Center, Inc., 473
U.S. 432, 440 (1985). Youth is not such a factor — young age
is quite often relevant to valid state concerns, as the Constitu-
tion itself attests. See U.S. C
ONST
. art. I, § 2 (minimum age
for House of Representatives); id. § 3 (minimum age for
Senate); id. art. II, § 1 (minimum age for President). Mini-
mum age requirements for voting, marriage, driving, drink-
ing, employment, and the like cannot be dismissed as reflect-
ing ‘‘prejudice and antipathy’’ toward the young. Youth is
not ‘‘so seldom relevant’’ to legitimate state concerns that we
should assume that any law singling out the young is proba-
bly the result of anti-youth animus. Youth is more often
relevant than old age, which we know does not trigger
heightened scrutiny.
Nor are the characteristics that define the young markedly
more obvious or distinguishing than those that define the old.

In fact, the characteristics are simply opposite sides of the
same coin — age. Youth is also far less ‘‘immutable’’ than old
age: minors mature to majority and literally outgrow their
prior status; the old can but grow more so.
Ansche does point to one relevant difference between old
age and youth: political power. Older Americans can vote;
children cannot. A finding of ‘‘political powerless[ness],’’
Lyng, 477 U.S. at 638, however, even if defined solely in
terms of voting rights, is not enough to trigger heightened
scrutiny. Compare City of Cleburne, 473 U.S. at 442 (apply-
ing rational basis scrutiny to distinctions based on mental
retardation) with id. at 464 (Marshall, J., concurring in part
and dissenting in part) (observing that in most states the
mentally retarded cannot vote). Political powerlessness is
also not measured solely in terms of access to the ballot box,
for the broad array of laws and government programs dedi-
cated to protecting and nurturing children — combined with
the large numbers of voters who are parents or otherwise
concerned about children — belies the argument that children
and their needs cannot attract the attention of the legislature.
See id. at 445. We are rightly skeptical of paternalistic
arguments when it comes to classifications addressing adults,
see, e.g., Mississippi University for Women v. Hogan, 458
U.S. 718, 724–25 (1982), but the concern that the state not
treat adults like children surely does not prevent it from
treating children like children. WMATA’s haste to abandon
its challenged policy in the wake of adverse publicity confirms
that the interests of children are not lightly ignored by the
political process.
For all these reasons, we conclude that classifications based
on youth — like those based on age in general — do not
trigger heightened scrutiny for equal protection purposes.
B.
Ansche alternatively argues that her equal protection claim
is subject to heightened scrutiny because the challenged
classification burdens a fundamental right. It has been point-
ed out often enough that, in considering such a claim, much

turns on the level of generality at which the asserted funda-
mental right is defined. Compare Hutchins, 188 F.3d at 538
(plurality opinion) (‘‘We think that juveniles do not have a
fundamental right to be on the streets at night without adult
supervision.’’) with id. at 557 (Rogers, J., concurring in part
and dissenting in part) (‘‘the contested right should be de-
fined more abstractly TTT first without regard to age, and
second without regard to the manner in which it is exer-
cised’’).
Ansche defines the right at issue as the right to freedom
from restraint, see Zadvydas v. Davis, 533 U.S. 678, 690
(2001) and Foucha v. Louisiana, 504 U.S. 71, 86 (1992)
(plurality opinion), a right burdened by the defendants’ poli-
cies compelling the arrest of minors for trivial offenses. The
defendants, not surprisingly, define the right at issue far
more narrowly: for the defendants, the asserted right is the
right of a minor to be free from arrest when there is probable
cause, if the arrest is pursuant to a policy that precludes less
intrusive enforcement options. See District Br. 9. See also
id. at 12 (alternatively defining right as the right to eat within
the public transit system).
We think the proper degree of generality lies somewhere
between the two extremes offered by the parties. Like the
district court, we think the right at issue in this case is the
right of freedom of movement when there is probable cause
for arrest. Unlike the defendants’ proposal, this definition
does not depend on the challenged classification — minority
status — itself. Unlike the plaintiff’s proposal, it does not
ignore the plainly pertinent fact that we are dealing with a
conceded violation of a valid law, a fact that historically has
carried implications for the asserted right of free movement.
The plaintiff goes so far as to cite the Magna Carta in
claiming the fundamental freedom against ‘‘being taken [or]
imprisoned,’’ see Reply Br. 6 (quoting M
AGNA

, ch. 39),
but the very same provision of that historic charter recog-
nized an exception when the restraint on freedom was pursu-
ant to ‘‘the law of the land.’’ M

The law of this land does not recognize a fundamental right
to freedom of movement when there is probable cause for
arrest. Gerstein v. Pugh, 420 U.S. 103 (1975). That is true
even with respect to minor offenses. Atwater, 532 U.S. at
354. Ansche argues that these cases under the Fourth
Amendment do not resolve the equal protection claim, and
that is surely correct: simply because a practice passes
muster under the Fourth Amendment (arrest based on proba-
ble cause) does not mean that unequal treatment with respect
to that practice is consistent with equal protection. But the
assertion here is that heightened scrutiny under equal protec-
tion is required because the right affected is fundamental, and
Ansche has made no effort to establish that there is a
fundamental right, ‘‘deeply rooted in this Nation’s history and
tradition,’’ Washington v. Glucksberg, 521 U.S. 702, 720–21
(1997) (quotation omitted), to free movement when there is
probable cause for arrest. The fact that the Fourth Amend-
ment specifically addresses when freedom of movement may
be restrained, and permits such restraint upon probable
cause, makes any such effort exceedingly difficult. Cf. Gra-
ham v. Connor, 490 U.S. 386, 395 (1989).
C.
Rational basis review applies and we accord the challenged
policies a strong presumption of validity. We will uphold
them ‘‘if there is any reasonably conceivable state of facts
that could provide a rational basis for the classification.’’
FCC v. Beach Communications, 508 U.S. 307, 313 (1993).
What is more, ‘‘those attacking the rationality of the legisla-
tive classification have the burden ‘to negative every conceiva-
ble basis which might support it.’ ’’ Id. at 315 (quoting
Lehnhausen v. Lake Shore Auto Parts Co., 410 U.S. 356, 364
(1973)). We therefore need not review all the reasons given
by the defendants in support of the challenged distinction
between children and adults; it is enough that we find one
reason rational. We conclude that the no-citation policy for
minors is rationally related to the legitimate goal of promot-
ing parental awareness and involvement with children who
commit delinquent acts.

Issuing a citation to a child is complicated by the fact that
there is often no ready way to ensure that the child is
providing truthful or accurate identifying information. A
child often will not be carrying a form of identification, and
there is nothing to stop one from giving an officer a false
name — an entirely fanciful one or, better yet, the name of
the miscreant who pushed them on the playground that
morning. In this situation parents would be none the wiser
concerning the behavior of their children. The correction of
straying youth is an undisputed state interest and one differ-
ent from enforcing the law against adults. Because parents
and guardians play an essential role in that rehabilitative
process, it is reasonable for the District to seek to ensure
their participation, and the method chosen — detention until
the parent is notified and retrieves the child — certainly does
that, in a way issuing a citation might not. The district court
had and we too may have thoughts on the wisdom of this
policy choice — it is far from clear that the gains in certainty
of notification are worth the youthful trauma and tears — but
it is not our place to second-guess such legislative judgments.

judiciary to sit as a ‘‘superlegislature’’).
IV.
Ansche finally challenges her arrest on the ground that it
was an unreasonable seizure in violation of the Fourth
Amendment. This claim quickly runs into the Supreme
Court’s recent holding in Atwater. There, a woman chal-
lenged the constitutionality of her arrest for violating a state
statute requiring all motorists and front-seat passengers to
wear seat-belts. As in this case, there was no dispute that
the plaintiff had violated the statute in the presence of the
arresting officer and that state law authorized her arrest,
even though the offense was punishable by a fine no greater
than $50. Unlike the present case, by statute the officer in
Atwater had the option of issuing a citation instead of effect-
ing an arrest. 532 U.S. at 323–24.

The Court in Atwater undertook a two-step inquiry in
addressing the plaintiff’s argument that a warrantless arrest
for a fine-only offense was unreasonable under the Fourth
Amendment. It first concluded that Atwater’s argument that
such arrests were not supported by the common law at the
Founding, ‘‘while by no means insubstantial,’’ ultimately
failed. Id. at 327. The Court then declined the plaintiff’s
invitation ‘‘to mint a new rule of constitutional law’’ based on
a balancing of competing interests and an assessment accord-
ing to ‘‘traditional standards of reasonableness.’’ Id. at 345–
46. Reasoning that ‘‘the standard of probable cause ‘applie[s]
to all arrests, without the need to ‘‘balance’’ the interests and
circumstances involved in particular situations,’ ’’ the Court
concluded that ‘‘if an officer has probable cause to believe
that an individual has committed even a very minor criminal
offense in his presence, he may, without violating the Fourth
Amendment, arrest the offender.’’ Id. at 354 (quoting Duna-
way v. New York, 442 U.S. 200, 208 (1979)).
On the basis of this passage, the defendants argue that
Ansche’s arrest does not violate the Fourth Amendment, for
it is undisputed that the arresting officer had probable cause
to believe Ansche had committed a criminal offense, however
minor. No balancing or inquiry into whether Ansche’s proba-
ble cause arrest was otherwise reasonable is permitted.
Ansche reads Atwater quite differently. In her view, the
Court’s analysis can only be understood in terms of the
Court’s concern to avoid interfering with the discretion of
police officers called upon to decide, ‘‘on the spur (and in the
heat) of the moment,’’ id. at 347, whether to arrest or to issue
a citation. The Court acknowledged that ‘‘if we were to
derive a rule exclusively to address the uncontested facts of
this case, Atwater might well prevail.’’ Id. at 346. But
because a rule allowing ad hoc reasonableness review of an
arrest decision, even when there is probable cause, would
hobble the officer’s discretion, the Court declined to engage in
any inquiry beyond probable cause.
The present case is different, Ansche reasons, because here
there was no exercise of discretion by the arresting officer.

The officer did not have the choice of issuing a citation;
arrest was the only enforcement option. Inquiring into the
reasonableness of the arrest would not intrude upon the
officer’s discretion, and therefore Atwater should not preclude
such an inquiry. Indeed, the Court’s comments about how it
would view Atwater’s claims were it free to balance the
competing interests strongly suggest that it would find the
regime in this case constitutionally unreasonable. See id. at
347 (‘‘Atwater’s claim to live free of pointless indignity and
confinement clearly outweighs anything the City can raise
against it specific to her case.’’).
Although this argument is a creative one, we are ultimately
unpersuaded, and do not read Atwater as permitting us to
engage in an evaluation of the reasonableness of the decision
to arrest Ansche, given the existence of probable cause. It is
certainly true that the Court in Atwater voiced concern that
imposing Fourth Amendment reasonableness standards above
and beyond probable cause would unduly intrude upon ‘‘dis-
cretionary judgment in the field’’ and interfere with ‘‘an
officer on the street’’ called to act ‘‘on a moment’s notice.’’
Id. at 347, 348, 350. That was the factual situation in that
case. At the same time, however, law enforcement discretion
is also exercised at more removed policymaking levels, as
with the no-citation and zero-tolerance policies at issue here.
There is no reason to suppose that the Atwater Court’s
conclusion — that the benefits from additional reasonableness
standards beyond probable cause were not worth the burden
on law enforcement discretion — was restricted to the burden
on the officer in the field. In fact, when the Atwater Court
dismissed the arguments for additional reasonableness stan-
dards as attempts to impose ‘‘something akin to a ‘least-
restrictive-alternative’ limitation’’ that was ‘‘generally thought
inappropriate in working out Fourth Amendment protection,’’
id. at 350, the two cases the Court cited — Skinner v.
Railway Labor Executives’ Ass’n, 489 U.S. 602, 629 n.9 (1989)
and United States v. Martinez–Fuerte, 428 U.S. 543 (1976) —
both rejected least-restrictive-alternative arguments in situa-
tions not involving the discretion of officers in the field.

In addition, the ‘‘very fact that [Fourth Amendment] law
has never jelled the way Atwater would have it’’ led the Court
to doubt ‘‘whether warrantless misdemeanor arrests need
constitutional attention.’’ 532 U.S. at 351–52. The Court
enumerated a number of protections, both constitutional and
practical, that it thought obviated the need for reasonableness
scrutiny above and beyond probable cause. Id. at 351–53.
The Court concluded that ‘‘[t]he upshot of all these influences,
combined with the good sense (and, failing that, political
accountability) of most local lawmakers and law-enforcement
officials, is a dearth of horribles demanding redress.’’ Id. at
353 (emphasis added). The Atwater Court even cited
WMATA’s decision in this case to change its policy, and to
provide for citations in lieu of arrest for ‘‘subway snackers,’’
as an example of the efficacy of the ‘‘practical and political
considerations’’ supporting the absence of a need for a rea-
sonableness balancing beyond probable cause. Id. at 353
n.23.
While we can inquire into the reasonableness of the manner
in which an arrest is conducted, see, e.g., Whren v. United
States, 517 U.S. 806, 818 (1996) (‘‘Where probable cause has
existed, the only cases in which we have found it necessary
actually to perform the ‘balancing’ analysis involved searches
and seizures conducted in an extraordinary manner, unusually
harmful to an individual’s privacy or even physical inter-
ests.’’); Graham, 490 U.S. at 394 (excessive force unconstitu-
tional conduct actionable under § 1983); Tennessee v. Gar-
ner, 471 U.S. 1, 3 (1985) (use of deadly force reasonable only
when officer has probable cause that fleeing suspect poses
harm), the most natural reading of Atwater is that we cannot
inquire further into the reasonableness of a decision to arrest
when it is supported by probable cause. That is true whether
the decision to arrest upon probable cause is made by the
officer on the beat or at a more removed policy level.
Even if Atwater were not controlling, Ansche has not made
the case that her arrest was unconstitutional. Her claim that
a policy of mandatory arrest for certain minor offenses is
unconstitutional boils down to an assertion that officer discre-
tion is a necessary element of a valid seizure under the
Fourth Amendment, at least for some minor offenses. She

has not made an effort to defend that assertion under the
usual first step of any analysis of whether particular govern-
ment action violates the Fourth Amendment — asking
‘‘whether the action was regarded as an unlawful search or
seizure under the common law when the Amendment was
framed.’’ Wyoming v. Houghton, 526 U.S. 295, 299 (1999).

Moreover, insisting on the exercise of discretion by an
arresting officer would be an unfamiliar imperative under the
Fourth Amendment. ‘‘The essential purpose of the proscrip-
tions in the Fourth Amendment is to impose a standard of
‘reasonableness’ upon the exercise of discretion by govern-
ment officialsTTTT’’ Delaware v. Prouse, 440 U.S. 648, 653–54
(1979) (footnote omitted). See also Whren, 517 U.S. at 817–18
(requirement of individualized suspicion ‘‘necessary to ensure
that police discretion is sufficiently constrained’’); United
States v. Brignoni–Ponce, 422 U.S. 873, 882 (1975) (‘‘To
approve roving-patrol stops of all vehicles in the border area,
without any suspicion that a particular vehicle is carrying
illegal immigrants, would subject the residents of these and
other areas to potentially unlimited interference with their
use of the highways, solely at the discretion of Border Patrol
officers.’’); McDonald v. United States, 335 U.S. 451, 455–56
(1948) (‘‘The right of privacy was deemed too precious to
entrust to the discretion of those whose job is the detection of
crime and the arrest of criminals.’’). It is the high office of
the Fourth Amendment to constrain law enforcement discre-
tion; we see no basis for turning the usual Fourth Amend-
ment approach on its head and finding a government practice
unconstitutional solely because it lacks a sufficient role for
discretionary judgment.
* * *
Nothing requires that the no-citation policy for minors be
subjected to heightened scrutiny. That policy is rationally
related to the legitimate governmental interest in ensuring
parents are notified of their child’s transgressions. Given the
undisputed existence of probable cause, Atwater precludes

further inquiry into the reasonableness of Ansche’s arrest
under the Fourth Amendment.
The judgment of the district court is affirmed.

Some idiot petty bourgeois middle class piece of delusional tragedy came on the TV as they normally do without warning, in a 1:15 hour short film. Generally, I would not give a darn, what these people (idiots) say. I mean, “What these idiots would say”?, If I cared what they say, after all they barely were educated for jobs, a step or two above common laborers, so “How good could their proficiency be?”.
 
Sounds snobbish well it is not, I am merely stating facts, in the mother tongue of English most people refrain from reading serious reading, and especially the classics once they leave school. Most after all upon graduating High school, and college barely are proficient in what they were required to be qualified in, during the enrolment at those institutions, and then they are suppose to forget it all, a short time after they leave those schools. Unless they some how push themselves into maintaining a work load, even though they would unaccredited for those studies they will not be very much “prepared” (?), I mean up to such matters.
 
So generally when people start telling me how they went to college, graduated, and have degree, I look at them twice and start sharpening my swords and daggers, as I very well can expect what is coming next.
 
I hope that if we ever meet (I have experienced the experience before) they would keep their verbiage of career based ambitions to themselves, as I hate them. Frustrated in a sense (not really) since I barely received a high school GED (“General Equivalency Diploma”), and have since refrained from pursuing further since in actuality I have a terrible distain for the institutions of society especial bourgeois society. The pretentious “middle class” (middle income groups) , they are too well off to be poor, and not well off enough to be rich. The middle class vies for power, pandering between the classes not completely swayed by either arguments or are there for dedicated to maneuvers I find emotional distressing to say the least. But what the heck they aren’t all that bad after all that reminds me of most of my relatives.
 
But none the less, they are to me the most despicable to me, in their trying to explain such theories, especially since most of them don’t have the brain write up a deal, or if they do, with the principles of a leech as they are ready to sell out at first chance they get.
So it was an inspiring moment of hate and hatred, they get me started on, by harping a few choice words, which constitute favorite pet peeves of mine.
 
On one hand, the author, screenwriter, who soon started talking about country club snobs, while then also on the other hand seemed to believe that some people are “losers”, and started rambling about what constitutes a “loser”.
As if that opinion is a reality of validity that extends beyond the confines their own personal thinking merely shows that author’s ignorance, and what a sick bastard he is. So sitting there he was making me bloody damn sick. Like I wanted to puke.
 
For the record:
First: Anyone who believes, there is such a thing as a “loser”
Second: Anyone who throws a round the “loser” label
Third: Anyone who believes diligent hard working people can be really “losers”.
Fourth: The only thing needed for success is the recognition of a salary, by what pays the bills, in a manner keeping up with the Jones.
 
Those neurotics are what a “loser” most probably is, because it combines the middle class pretensions with ignoble capitalist materialism. After the entire western world based is on the desirability of some choices over others, but which some cannot accept, nor who they really are. As people are confused and tormented by the dual roles they play as mother, and father. As gays think they are women trapped in male bodies, they aspire to a success which is not readily obtainable, and realizing that fear failure. The fear of failure generates a shame of where they are, or from they have been, what they have done, have they done enough, so they second guess themselves, as psychological “losers” who cannot live with them selves.
 
In a pain which manifests in many ways thru suffering they share, but which I find all too painful in hearing because that is not everybody’s thing, and in actuality I would be satisfied to be left alone , and allowed to do pretty much what I have done since a child. For I too feel that pain when society erects standards for which they accept no responsibility of obtaining with consideration of the emotions people have.
 
For by definition society’s standards are society’s standards, not the individuals, and even if libertarian anarchists strangely enough would be able to become those that established society’s standards it would be society’s standards imposed on individuals.
A society perhaps forever corrupting, and tainting what it touches, starting at birth at the mother’s breast-feeding, in a Spartan birth where traditionally babies were tested put out exposed to the elements at birth.

Hence where from what America reminds me of every day of my life, summarized in those “weird”, “loser” conversations diseased (as they are). The are the dialogues and those same persons, who faithfully uphold these strange standards of mixed blessings, and use the labels of “weird” to describe fairly normally behaving people, adults or juveniles, in a mass produced delusional neurosis of a society dreamed of but which doesn’t exist, nor may ever exist.
 
It is a society existing in most of the industrial society (perhaps more out of need in the Third World”), though perhaps more so in the United States, though I have seen not limitations to the boundaries of such illnesses.
 
Of real and perceived needs, in a society which I add has socially worsened, more pervasive in its neurosis since women have entered the market place (not that women should be keep out of the work force, barefoot, pregnant and in the kitchen), but because it added fuel to the fire, and more victims to be consumed by the illness.
 
An insecure society of “losers” projecting their personal insecurities upon all those around them, whether they say so or not, of fears that bounce back and forth, re-enforcing their problem, in adults as in children. As the “sins of the fathers will be visited upon their child unto the fourth and fifth generations.”
 
In any case good luck folks, after watching programming like that maybe I need therapy too, and I do not feel very well about it all. How do I collect “bad” vibes hmm? Hmm, let us see. What vibes, I do not know what you are talking about. After all, I said means, which often can vary, but inspired me.
 
By the way, I still have not forgotten a comment I heard the other day, in that I stay home so often two to three weeks at a stretch, “sounds like a personal problem”, hmm.
 
Jeez a messed up society like ours, and maybe everyone should have “personal problems” such that, as most often I enjoy being home more than when I go out amongst the “weird losers”, their insensitive language, and inconsideration, foul language, and manifestations. Because when I tell people to “go screw yourself” I mean it, unlike the pretensions of “losers”, for I am unaccustomed to “losers” who fumble around trying to explain confused tormented perspectives. Tormented to one standard or another the market place attempts to goat into moving to its beckoned called. MOMMY MOMMY LOOK LOOK CAN YOU BUY IT?

Where does the reality begin? Something wrong is going on, when mixed messages are received as to what is going out there in society, aka the real world.
 
On one hand we are presented with images of “Mad Max”, “Road Warrior”, “Escape from New York”, “The crucifixion of Christ”, “Braveheart”, “Harry Potter”, “Dirty Harry”, “The Planet of the Apes”, “Outer Limits”, “Escape From the Planet of the Apes”, “Bronson”, “Death Wish”, 1,2,3,4,5.
 
We are daily barraged and presented twisted politically conservative visions doom and gloom messages of America, and the World, in arrays from A - Z. That is not to say some of that is not true, but admitted it is grossly taken out of context, when contrasted on a day-to-day basis, of what people expect, and are accustomed.
 
Is it needless for me to mention that the doom and gloom cinema-graphic school is heavily endowed with conservatives who also want us to indulge in their fantasies of an America that reminds some of “Leave it to Beaver”:

A career, which began as merely a job for a TV series, for the case, always seems very unrealistic, and baseless, when taken into the context of the full iconography of American cinematography contrasted with films depicting the likes of:

There are numerous people swearing that they too are victims when there are fine lines between the deranged and being a victim.

Psychotronics is part of “parasciences” that was popular during the Cold War, as part of what I believe were disinformation campaigns by the East and West intelligence agents: as a means to accomplish ends, constructed often to generate enemy interest, as pretexts for the erroneous expenditure, of tactical and strategic resources.

Just as Aliens from other planets came to us to become part of American and eventually folk culture not through governmental research, or corporate development, we first became acquainted with space and aliens seen as:

Too bad the Computer Industry and Information Technology have never, I repeat never, ever really fully tested anything they ever produced. Perhaps “Beta Testing”, is the corner stone foundation of the industry that made the phrase so well known. To the best of my knowledge, the whole Automotive Industry (Ford, General Motors, Chrysler, Toyota , Honda, BMW, Daimler, Mercedes-Benz, Fiat, Peugeot, Yugo automobile companies) have never produced a constant flow of cars, only to later have release revisions in what occurs often on a daily basis. As a matter of fact most PC computer users need ready access to telephones, and the internet in order to get computers properly functioning and operational, even if they might live in Third World villages. From what I understand messages can be posted onto blogs but emailing them, I grabed notice of this when I saw mention of an option that allegedly allows photos to be posted by picture phone. In Any case I needed a message to test the system so this is it.
 
P.S. As of late I received the following message to show how inconsistent the varied services are online Where Blogger allows posting via email, as does Windows Live Spaces, which may become a issue much like others became pivital in those companies quest for market share.

One Week After by Andrew Stergiou
 
Today is Tuesday. last week I hit 240 lbs. due to caloric and water weight gain, soon there after I quickly lost about 8 lbs due to some sort of rapid water loss (I have no idea what happened maybe I stepped on the scale the wrong way, I am only a size 8 wide).
 
Any way Today I hit early 224 lbs., after that: I had some coffee with sweetener, and a little molasses (I ran out of sweetener), adding coffee creamer (check out the calories of that stuff it is high that is how they get it to taste so good, but it keeps forever, when nobody wants to go shopping everyday). a good bowl of sprouts (30-60 calories, but with 2 tablespoons of blue cheese dressing [110 calories though half was stuck to the bowl I used, it was 55 calories). One carrot raw cost me 72 calories.
 
But I wanted some more sweetener so I went out and bought groceries for the new diet /lifestyle (about 75 pounds worth of groceries [I added it all up want me to list it?]).
Carrying it back a half mile or so (not much, sometimes actually I wish it was a longer walk]) to the house by means of my military duffel bag. I live in a hilly area, and had to climb stairs to cross a few street, so with the darn thing, so I am doing pretty good (with only one rest stop).
 
Unfortunately I have to stay home a lot since I have a lot of things to do at home, writing, and all, so now I am sitting down after my chores, of shopping, lugging those groceries home, double-checking what I was charged.
 Making sure I was not overcharged, as all too often happens (please keep your gimics I like straight forward business, and responsibility), then typing out this short blurb for all you good folks, double checking my facts, making, and having another coffee). Primo fine ground Columbian, and Espresso coffee mix, with cinnamon, sweetener (a tablespoon), and a tablespoon of creamer, so I can go back to writing or something.
 
Watching TV and soon taking my shoes/sneakers off, watching on The SUNDANCE channel, "Who Killed Bambi?", (French movie, 2003).
 
"Who Killed Bambi?", about “a student nurse who is prone to fainting spells suspects a hospital's star surgeon is harming patients”, which appears as a commercial production (good work technically):
Though presented on the Sundance channel, which gets some sort of hype due to its use of the “Sundance” name (named after a Film festival, which is also supposed to imply it presents independent films, not commercial productions, as they appear to do. I have seen many commercial productions of that channels and thing it debases the reputation of the Sundance name, or infringes upon it.
Is it an independent film merely because it is "French" (the stupidity of industry)? French certainly would consider it commercial!

LOSING WEIGHT: HEY MA SEE SKINNY by Andrew Stergiou
  
       Don't ask me about next week, and or even tomorrow, today I am on a diet! Maybe tomorrow I will crack and fall off the diet. First of all the diet isn't with any specific rules. I can't have any rules, as to what I can do, when one day I am in one mood, tomorrow another, and I can’t figure it all out.
       It really makes me feel silly (and stupid) and vain, but the only thing that counts is my losing some weight. I have not really lost any weight since I was a teenager when I was about 120 pounds. Keeping my weight was never an issue as I was in the past very active playing sports as a teen, and as a manual laborer. I also never subscribed to the western society’s (especially American) standards regarding weight.
       Where most of the world is envious of western and American obesity, here being thin is a class issue in that those of lower incomes can not always afford those foods which are better for us. We tend to eat foods convenient for us that are pre-made and pre-salted. We are bombarded commercially to buy what is not healthy for us by the fast food industry making high profits with cheap labor, and cheap carbohydrate, oil, and sugar based foods.
        Neither have I subscribed to the generally middle class fringe like cults regarding “health foods” (Nazi fruitarians, New Left Homoeopathic cults, nor will I support monopoly capitalism now that they have gone into organic food production, sales, distribution in a big way (as their profits rates there are higher than in regular food production, and since they plan on taking it over, as with every thing else).
     At 240 pounds last week I was about double According to U.S. Government sources that is obese for my height (5'11" in height). The government also says that for my height, my normal weight is supposed to be approximately 133-179 lbs. More is obese, and fat, while less is underweight and skinny. So I don't know really how much weight I should be since they didn’t really explain it.
     In any case I noticed my weight hit 240 lbs. about 4-5 days ago (which was strange because it was some sort of water weight gain that went up and then down 10 lbs in 24 hours).
     So then finally I hope I decided that I had to lose weight when it went up, and will do some serious dieting to lose weight. This time I was lucky went it went straight back down in twenty-four hours (thankful too I think), but then again maybe not since that is very unhealthy.
     So I started dieting then. I have been drinking coffee, and a lot of water (to reduce the body salt - body salt, and salt intake adds retaining water weight which I don't need since I want to lose weight).
     I don't add much to my coffee but I spice it up with molasses (15 calories per tablespoon), cinnamon (no calories), with maybe a little non-diary coffee creamer (30-50 calories, I like light coffee, and good as even non-fat evaporated milk is 10 calories per tablespoon without the body my high point of the moment/today) . I also add a little instant coffee, chicory mix (TASTY, STRONG, and leaves a syrupy goo at the bottom of the cup) .
      ANY WAY. I am trying as best I can without support, nor interference (I have holed up in my pad and haven’t gone out for a week.
     I have hooked up some lentils (not beans actually legumes) to sprouts as recently I bought 8 pounds of dry lentils at 40 cents a pound (a great buy, so I have plenty).
     I am considering buying out the store’s entire stock though I have also about 40 pounds of Kidney beans, and 5 pounds of mixed beans to make sprouts with ( I have to research that so stay tuned for comments).
  I concocted a soup from a cup of water with a handful of sprouts (after I boil half an onion in it), adding: a little tomato sauce (from a jar), one teaspoon of dry soup mix (chicken tomato), some garlic powder, and a healthy dash of hot sauce.
      I had two bowls of that yesterday, and about three to fours cups of coffee, and as much water as I could stand), while I also plan a strategy of dieting on spinach (28oz. cans $1 as I hook that up also with soup base, chopped onions, garlic powder, I recall that that today I tossed a good spoon of spinach into one of the bowls of soup to change the flavor up, and make it interesting of the bowls of soups, so I would keep it up.
      Recently I watched a documentary on the explorers who were the first to the south pole I think, who focused heavily on personal hygiene to keep up the morale which I have taken as a lesson. The other day I had half a matzo (as today), and two days a can of sardines (I drained the oil, as I like fish as taster canned in oil rather than water/brine).
     Beside that I don’t really remember what else I ate but which even with cheating has seen me lose 14 pounds in the past fours days 96 hours. If it bothers me I will sleep it off, if I can’t sleep any more, when I wake I will work it off, hopefully losing the weight.

Diet foods SUK, as capitalism does, and often only sells us, on a large scale, what we can do better, on a smaller scale, as they take advantage of us when we are being lazy.

I always sort of wanted a Buddha Belly but then when I gained weight it didn't feel quite right.  Some times I felt dizzy, and ill, simply not at my best.
 
Do I look like this? Of course not!
 
One of my last "girl friends" made me feel awfully self-consciencious about my weight, and of course my ahole relatives just couldn't keep their mouths shut, be cause they don't know how to mind their own business, like they say "They can't run their own lives, I'd be damned if they run mine!".
 
Friggin hell with half the world starving, I am bloody driving myself sick, in that I've gained weight to the point I have to lose it, and am now dieting (albeit what they say I shouldn't [crash dieting]) with limited intake to take the edge off, and calm the hunger pains.
Actually once I went on hunger strike in protest without eating or drinking even water for ten days, where they forcibly hospitalized me.
 
Who the heck am I Elvis to be worrying, and complaining upset about my weight? I am actually not that bad especialy for my age.
 
I must be vain? naw.. it actually affects me as I often send so much time at home writing, practicing guitar, getting online, taking care of my blogs, groups, and web sites.
Though admittedly I have gained 100 lbs, since I was a teenager, and I am never going back there, I'd like to lose maybe sixty pounds (I am 5'11" and 228lbs. presently).
 
Now I am merely switching to a veggie diet canned spinach, with a thin slice of cheese, a liberal use of powdered garlic and soup base to flavor it all (28oz. can of Spinach, daily) with a touch of Parmesan Cheese just for flavor. I'm drinkling coffee, and baking cocoa, with molassas, and some creamer.
 
Today actually I ate nothing solid yet, and I have been awake 14 hours, and I'm am about to maybe crash out, and go to sleep. Jeez Fleas.
 
There has been some issue about water weight, and salt intake, which I don't fully understand and which radically changes stuff as it caused me to gain 8 lbs and lose 10 lbs in a 24 hour period (GOD HELP THEM SKINNY MODELS I REALLY UNDERSTAND I THINK) Any way I am at it again.

Merely because I post a message in a email group does no mean that other members o f that email groups should comment on such postings, nor be rude, nor persistent in commenting after they person making such posting has already expressed their displeasure of such comments, nor act in manner of provocation harassing posters as:
 
(a) that has already been found illegal by some courts

Well let me help you discern that by use of other perhaps more objective sources since I had one of the first political online system in the world at a time such things were the exclusive domains of white college educated upper income libertarian to conservative geeks. Military, police, intelligence political attempts to influence the public’s political views is nothing new in fact it was the position Hitler was hired to fill by the Wehrmacht of the Weimar Republic a good social-democratic administration. WASHINGTON (CNN) -- The Pentagon has begun a new "rapid response" operation to quickly respond to news media stories critical of Defense Secretary Donald Rumsfeld and the war in Iraq, as well as other stories the Defense Department leadership doesn't like.
 
The operation is similar to those used in political campaigns, but officials say the new organization was not started specifically because of rising criticism of the war.
 
Defense Department Press Secretary Eric Ruff could not immediately provide statistics regarding the cost of the new operation or the number of people involved. He confirmed, however, that it is expected some of the new staff members will be political appointees or contractors.
 
"We are staffing up considerably," Ruff told reporters.
 
He described the new operation specifically as "rapid response" so that the Pentagon could "get inside the news cycle" of 24/7 operations.
 
"Al Qaeda has demonstrated time and again how to use the Internet and time and again how to use video effectively," Ruff said.
 
Rumsfeld has criticized the media for focusing on what he characterizes as the negative news coming out of Iraq.
 
The new operation will have four branches, according to an Oct. 3 memo from Dorrance Smith, assistant secretary of defense for public affairs. In each case, the plan is to have these units respond rapidly to critics or offer "information products" developed by the staff.
 
The branches, according to the memo, are:
 
New Media: "Creating products and distributing information" for the Internet, podcasting, DVDs and Web sites, including You Tube.
 
Rapid Response: "Develop messages and products for the 24/7 media cycle," including letters to the editor. In recent weeks, there has been an increase in Pentagon-written letters to the editors of dozens of news organizations. Those are now posted on the Defense Department's Web site, including letters that news organizations have declined to publish, and letters asking for corrections in editorials.
 
TV and Radio Booking: "Enhance effort to provide civilian and military guests for cable network and radio programs."
 
Surrogates: "Provide information and visibility to the surrogate community." Those are mainly analysts who speak publicly, often on behalf of the Pentagon.
 
Smith said the plan will result in "more timely responses to breaking news" as well as "more briefings" and "greater press access to DoD officials." However, Smith himself has never publicly briefed the press corps and has said he will not do so.
 
The new operation is beginning to take shape physically as well. On Friday, about half the press office was walled off so the new hires could sit out of public view.

Looking at Buddha's life before he was 'Buddha', he was Siddhartha.
Remember how he was protected and oversheltered from seeing any
pain, or suffering, or old age, or death. And he went on a horse
carriage ride with his servant. He begged his servant to go to town
with him. His servant was reluctant to allow him to come, because he
would no longer be 'naive' and learn the ways of the world were not
all crimson and perfect. The first person he saw was an elderly man
who hobbled about with a cane, bent over and aged. Siddhartha had
never seen or known anyone like this, he learned about aging from
seeing this elderly man bent in shape. There was probably more to
the story, but that is all that comes to mind right now. He later
went home and then wanted to be alone and meditate. Of course his
parents were horrified. They wanted him to be a 'worldly man', not a
sadhu. Remember when Siddhattha (later known as Buddha) was born an
astrologer told his parents he would either be a great ruler, or a
great saint. In order to be a great ruler he was to be spared of all
things that were not perfect, i.e. elderly people, suffering, etc.
So his parents wanted him to always have everything and stay away
from poverty and suffering. Destiny is destiny, and eventually he
saw what his parents wanted him 'not to see', they wanted a perfect
life for their 'future ruler', but he was human, and needed to see
the suffering so he could have COMPASSION, for without suffering
how could he KNOW compassion.
However does this mean that the elderly that live in nursing homes
need to suffer, want to suffer, have to suffer....Perhaps you
noticing their hardships helps you to maybe make a difference for
them, for you, for future elders...Suffering comes with the
dimensions of earth. However there are means to elevate yourself,
oneself from this 'pain', or maybe change and do things differently,
like Buddha did.

In the last twenty-four hours I received the sad news Noted author, artist, WWII vet, and all round mensch Irving Stetner pasted away. As we were out of touch for some time, and usually on Lower East Side Patrol the news came to me as of late as if it was yesterday, to whose family I offer my sincere condolences and respects.
 
Strangely I started off my email "Re: IRVING I AM SO HAPPY" because I had not realized that Irving had passed away, for which deficiency I also offer my sincere regrets to his family.

Recently I have been offering a deal where I have been soliciting finished manuscripts from authors so I could publish them.
As a result of this project so far I have come up against a couple of different issues the NUMBER ONE ISSUES are those modeled along the Amazon.com model. Amazon.com a publicly traded corporation has entered the books on demand market and offers to print authors under what I would call highly questionable circumstances for the serious author.
 
Typically Amazon requires specific standards, conditions and terms to be met which I have had to study in order to make a presentation in the issues. I focused my sights on writing this based on Amazon.com because of their central positioning in books.  PRINT ON DEMAND (POD) publishing.
 
Since Amazon doesn't acquire the rights to the works they publish that has become one of the main issues regarding regular publication of works as authors have asked to retain their rights (first issue is that they do no register nor administer copyrights)
 
Secondly by regular publication a publisher obtains, and retains rights to publish books. If their don't obtain and retain rights to publish those works under contract, why should they bother to do so, after all it is a business, not a social affair so ask "What are their motivations for publishing".
 
Generally because of the low Print On Demand books production runs are at higher fixed pricing they CAN NOT compete on the regular book market
while Publishers ON DEMAND make money on every book you sell friends and family at inflated prices All these wonderful gimmicks of manufacturing limited runs items cups, books, woven carry bags, rugs etc can not compete in the marketplace by selling e.g. coffee mugs with baby's photo on it as they look sweet but commercially is unpractical at $10-20 per cup when at discount stores cups are sold new at 59 cents, and often there is a glut of cups in thrift stores.
 
So there is required a give and take in publishing generally governed by contractual terms and conditions.
 
Also there are standards requiring costs involved with publishing Amazon Books on Demand regarding layout, and graphics that run from $500 and up to $2400 regarding poetry styles of layouts which you have to pay out of your own pockets while receiving NOTHING FREE from Amazon.
 
Formatting your manuscript • ISBN barcode Online listings $499, Basic Copy Editing $1,500 Unique Cover Selection (NOT DESIGN)
$499, Advanced Marketing Copy  your back cover text • Short paragraph describing your book • Condensed sentence description • Author biography $199 Comprehensive Copy Editing $3,000,  Cover Design photography and graphic images $999, layout and book publishing service for black and white interior book manuscript submissions $499 Advanced Marketing Copy • Short paragraph describing your book • Condensed sentence description • Author biography $199 Author Domain Service bookselling page $189 Publicity Kit $499 Promotional Copy $399
 
 499+ 1500+ 499+ 199+ 3000+ 999+ 189+ 499+ 399 = $7384 in give or take that is an expensive process YOU PAY FOR which "privilege you receive 25% of the wholesale of an overpriced book. Without getting really neither published, nor getting copies of your book for all that money you spent.
